ORDINANCE NO" 1650
. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY ESTABLISHING
AN INITIAL ZONING DESIGNATION OF "R-3" (RESIDENTIAL MEDIUM DENSITY
DISTRICT) ON APPROXIMATELY 88 ACRES SITUATED IN A PORTION OF THE
SW% AND SE% OF SECTION 3, T2S, R5E, PMM, GALLATIN COUNTY,
MONTANA.
WHEREAS, the proposed zone map amendment to establish a new zoning designation of "R-3",
(Residential Medium Density District) on approximately 88 acres has been properly submitted, reviewed
and advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a public hearing on June 15, 2004,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on July 12, 2004,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M,C,A., and found the proposed zone map amendment, as
. recommended by the Zoning Commission, to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on July 12, 2004, the City Commission found that the proposed
zone map amendment would be in compliance with the Bozeman 2020 Community Plan and would be
in the public interest contingent upon annexation; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution No.
3847, adopted on the 19th day of September, 2005,
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation ofthe following-described property is hereby established as
"R-3" (Residential Medium Density District):
A tract of land being portions of the EY:1SW~ and the WY:1WY:1SE~ Section 3, T2S,
R5E, P,M.M" Gallatin County, Montana, and being further described as follows:
Beginning at the C-W1 /16 corner of said Section 3; thence along the E-W mid-section
line N89048'24"E a distance of 1980,89 feet to the C-W-E1/64 corner; thence along
the W-E1/64 line SOoo58'57"W a distance of 1972,98 feet to the northeast corner of
Diamond Estates Subdivision No, 2 Phase I; thence along the north line of said Phase
. I and the north line of Lot 1 of Minor Subdivision No, 253 N89059'30"W a distance of
1604,37 feet to the southeast corner of Tract 1 of Certificate of Survey No, 2360;
thence along the east line of said Tract 1 NOo050'29"E a distance of 127.60 feet to the

northeast corner of said Tract 1; thence along the north line of said Tract 1
N89059'30"W a distance of 371,54 feet to a point on the W1/161ine of said Section 3;
. thence along said W1 /16 line NOQo50'28"E a distance of 1838.33 feet to the Point of
Beginning. Said tract being 88,346 acres along with and subject to any existing
easements.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading,
