ORDINANCE NO. 1648
. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP FROM R-S
(RESIDENTIAL SUBURBAN DISTRICT) TO R-O (RESIDENTIAL OFFICE
DISTRICT) ON 10 ACRES, ON PROPERTY DESCRIBED AS A PORTION OF
TRACT 3 OF CERTIFICATE OF SURVEY NO" 2047, LOCATED IN THE
NORTHEAST ONE-QUARTER OF SECTION 17, TOWNSHIP 2 SOUTH, RANGE 6
EAST, PRINCIPAL MERIDIAN MONTANA, CITY OF BOZEMAN, GALLATIN
COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to amend the City of Bozeman Zone Map from
R-S (Residential Suburban District) to R-O (Residential Office District) on 10 acres, has been properly
submitted, reviewed and advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on June 21 ,2005 that was
continued to June 28, 2005, to receive and review all written and oral testimony on the request for a zone
map amendment; and
WHEREAS, upon a vote of 3-0 the Bozeman Zoning Commission recommended to the
Bozeman City Commission that the zone map amendment be approved as proposed; and
WHEREAS, after proper notice, the City Commission held it's public hearing on July 5, 2005,
. to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment to be in
compliance with the twelve criteria; and
WHEREAS, at its meeting held on July 5, 2005, the City Commission found that the proposed
zone map amendment would be in compliance with Bozeman's adopted growth policy and would be in
the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That upon a vote of 5-0, the zoning district designation of the following-described property is
hereby designated as R-O (Residential Office District):
A tract of land being a portion of Tract 3 of Certificate of Survey No, 2047, located in
the Northeast One-Quarter of Section 17, Township 2 South, Range 6 East, Principal
Meridian Montana, City of Bozeman, Gallatin County, Montana and being more
. particularly described as follows:

Beginning at a point which bears South 88035'56" East a distance of 596.05 feet from
the North One-Quarter Corner of Section 17, Thence South 88035'56" East, along the
. north line of said Section 17 a distance of 362.60 feet to the Northeast Corner of said
Tract 3. Thence along the easterly line of said Tract 3 through the following courses:
South 59029'21" East, a distance of 296,22 feet; along a 1990,00 foot radius curve to
the left through a central angle of 04043'29" for an arc length of 164.10 feet, with a
chord bearing of South 53051'06" East, a distance of 164,05 feet; South 56012'51"
East, a distance of 491.33 feet. Thence North 88022'07" West, a distance of 1308,97
feet. Thence North 18014'13" East, a distance of 553,86 feet to the point of beginning,
Said tract of land being 10,00 acres, along with and subject to any existing easements,
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading,
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 6th day of September, 05.
