Hi Chris,So close....
I recommend allowing a path for allowing non conforming existing accessory buildings tobecome ADU's. The re-purposing of existing garages and accessory buildings (many of them
already studios, guest spaces and mother-in-law apartments without stoves). Re-purposingexisting structures is good for the environment, keeping them out of our landfill and goes to
further the cause of keeping historical character. Alternatively, people may choose to teardown existing buildings to build a conforming ADU.
A departure or deviation may be required if the existing building footprint is larger than the
600 sq. feet the new code allows (the majority of existing garages and accessory buildings) orbuildings that have a building mass that doesn't comply with the new accessory building
envelope requirement.
Currently the UDC update says in Section 38.36.40,A,6 - No deviations may be grantedallowing the establishment of an ADU.
I highly recommend adding some language to allow deviations or departures for existing
conditions at the planning departments discretion.
