SUBJECT: Initiation of Amendments to Chapter 38, BMC (UDC) Developed During UDC Update (known as “Pile B”)
MEETING DATE: December 18, 2017

RECOMMENDATION: The Commission formally initiate amendments to the City’s Unified Development Code (UDC) approved by Commission during adoption of the UDC Update.
SUGGESTED MOTION: I hereby move to initiate amendments to Chpt. 38, BMC listed in the
staff memorandum and which have previously been discussed by the City Commission during public hearings on the UDC Update which are referred to as “Pile B Amendments.” BACKGROUND: During the adoption of the UDC Update a majority of the Commission
identified eight amendments to the UDC which were not included in the notice for the UDC
Update. These eight amendments have been included in what staff refers to as “Pile B” for the UDC Update. This action will direct the initiation of these UDC amendments. Should these text amendments be adopted by the City Commission it is intended they become effective on March 31, 2017, the same date as proposed with Ordinance 1978, codifying the UDC Update.
List of Pile B Amendments: Pile B amendments include the following (note: the code citations are in the new UDC format as proposed with Ordinance 1978):
• 38.340.070.A:
o Amend second sentence as follows: “In order to encourage restoration, and rehabilitation and appropriate new construction activity that would contribute to the overall historic character of the community, deviations from underlying zoning requirements may be granted as described in division 38.250 of this chapter.”
o Amend A.1 to read “Modifications must be more historically appropriate for the building and/or site in question, the adjacent properties, and the overall pattern of the neighborhood as determined by the standards in section 38.340.050.”
• 38.340.080.C.1: Amend the first item in the list of optional provisional review criteria for
demolition or movement of historic structures or sites as follows: “1. The property’s historic significance and a neighborhood’s historical significance.”
• 38.360.030.G.1: Commission discussed (but no motion made) eliminating the requirement that accessory buildings not exceed the height of a principal building unless

such accessory building has otherwise been approved. Adding this item to Pile B will
instruct the staff to draft a recommendation for presentation to the Zoning Commission and City Commission.
• 38.360.110.E.1: Amend to add a subsection (h): “When cottage housing units meet the definition of affordable housing under division 38.380 the maximum units under (d) and
(e) do not apply. Every unit would have to be affordable, with the same proportion, in order to exceed the maximum.” Staff requests additional discussion with the Commissioners regarding the intent of this motion. The question is whether “with the same proportion” means if a cluster proposes, for example, 14 units, and there are two clusters totaling 28 in the development, must all 14 units in each cluster and therefore all
28 units in the development meet the definition of affordable home.
• 38.360.110.E.1(f): Delete this section regarding departures for cottage housing.
• 38.360.170.A.1: amend the distance from schools that medical marijuana storefronts may locate from 1000 feet to 400 feet.
• 38.360.170.A.1(a) and (b): amend criteria for a school for which the distance provision for medical marijuana storefronts applies. Specifically, the amendment will add the phrase “where students are regularly present” after “facilities” in both these subsections.
• 38.540.070.A.4: amend off-site parking standards by changing the distance from a
multiple household dwelling where offsite parking can be located from 100 feet to 300 feet. Proposed Schedule:

City Commission Public Hearing: Monday, February 12, 2018 UNRESOLVED ISSUES: None.
ALTERNATIVES: None recommended. FISCAL EFFECTS: Staff time and standard costs to prepare a text amendment and administer the public process.
