Some concerns about new ADUs becoming STRs and ADUs above garages in older neighborhoods.
ADUs as STRs
If the City’s intent in relaxing and clarifying ADU regulations is to increase infill and potential affordable housing
for full time renters, then the Commission needs to be concerned about new ADUs becoming Short Term Rentals.
INC recommended that :
“After (say) Jan 1, 2018, any new ADUs (in any residential zone) may not be registered (approved) as STRs.
(Add to Section 38.360.040 - Accessory dwelling units A. Standards for all ADUs: (pg 237 A in draft UDC).
Existing ADUs could still become STRs for vacationers in:
RS & R1 - Type 1 (in one or more bedrooms in an owner-occupied dwelling while owner is occupying the same
dwelling unit for entire rental period)
R2, R3, R4, R5, RO - Type 1 or Type 2 (in owner occupied dwelling if owner is not present or
in ADU whether or not owner is present in primary dwelling or
in a duplex whether or not duplex owner is present in other half of duplex)
But if new ADUs are used for STRs, then the City’s hope for infill to help meet full time renters needs falls way
short.
Please consider adding INC’s recommended wording to the UDC to truly make new ADUs for full time renters and
not vacationers.
Also about ADUs above garages.
In current code in R1 & RS ADUs above garages are only allowed in subdivisions receiving preliminary plat
approval after Jan 1, 1997.
Areas platted after Jan 1 1997 usually have been designed to accommodate an ADU above a garage - 2 story homes,
adequate parking and utility spacing.
But older neighborhoods in R1 & RS are challenged in keeping neighborhood character, parking, utilities, etc if
ADUs are built above garages.
So if the Jan1, 1997 requirement is removed in R1 & RS, then ADUs over garages would be possible in ALL R1 &
RS - older and newer.
R1 and RS zoning districts, however, could not turn an ADU over a garage into a STR since only Type 1 STRs are
allowed.
An ADU above a garage would have to be for longer term rental or for unpaid guests.
Please consider leaving the Jan 1, 1997 in place. Or moving the date back slightly to allow for ADUs above garages
in neighborhoods
