RESOLUTION 2017-05
A RESOLUTION OF THE PARKING COMMISSION OF THE CITY OF BOZEMAN, MONTANA,ADOPTING A SECURITY
CAMERA POLICY FOR THE BRIDGER PARK DOWNTOWN GARAGE.
WHEREAS, pursuant to Bozeman City Commission Resolution #3803, the Bozeman Parking Commission
has jurisdiction to regulate on-street and off-street parking the B-3 zoning district, and any residential parking
permit districts created by the Bozeman City Commission; and,
WHEREAS, the Bozeman Parking Commission is responsible for the operation and maintenance of the
Bridger Park Downtown Garage; and,
WHEREAS, the City of Bozeman and Bozeman Parking Commission have installed security cameras
throughout the Bridger Park Downtown Garage to provide security for customers and staff, and as a deterrent
to potential vandalism and other criminal activity; and,
WHEREAS, the Bozeman Parking Commission recognizes the need for a policy that governs the use of
the security camera system in an effective manner that protects the reasonable expectation of privacy by
citizens and entities;
NOW THEREFORE, BE IT RESOLVED that the Bozeman Parking Commission adopts a Security Camera
Policy for the Bridger Park Downtown Garage, attached hereto as Appendix A.
PASSED AND ADOPTED by the Parking Commission of the City of Bozeman, Montana, on first reading,
at a session held on the Fourteenth day of December 2017.This resolution shall become effective immediately.

POLICY 2017-05: Security Camera System

I. Purpose
The City of Bozeman (City) and the Bozeman Parking Commission (BPC) use security
cameras on BPC and City parking facilities to deter crime and vandalism. The purpose of this
policy is to provide guidelines regarding the use of security cameras at parking facilities
owned, operated, and maintained by the City. For the purpose of this policy, security camera
is defined as cameras used to enhance security and safety for customers, citizens, and
employees using City parking facilities. City, as used herein, refers to the BPC and employees
of the City's Parking Services Division (PSD).
The City's use of security camera monitoring and recording is limited to uses that do not violate
a person's reasonable expectation of privacy. Security camera monitoring must be conducted
in a professional, ethical, and legal manner. Monitoring individuals based on characteristics
of race, gender, ethnicity, disability, or other protected classification is prohibited.
The existence of this policy does not imply or guarantee that a camera will be monitored in
real time 24 hours a day, seven days a week.
II. Scope
This policy applies to all City employee's regarding the use of security camera monitoring and
recording conducted at City parking facilities. This policy excludes mobile License Plate
Recognition equipment, operated by the BPC, which is covered by separate policy documents
and is used exclusively for verification of compliance with parking use requirements.
III. Responsibilities
The Parking Program Manager (PPM) will be responsible for oversight of the installation,
maintenance, and utilization of the security camera system.
The PPM is responsible for the appropriate training and supervision of City personnel in the
use of the security camera system. Therefore, employees that have not been trained, to the
satisfaction of the PPM, will not have access to use the security camera system. All PSD
personnel will receive a copy of this policy, and provide written acknowledgement that they
have read and understand its contents.
The PPM must approve all requests for access to the security camera system, including real
time monitoring and/or recorded materials. Approval of such requests will be done with
counsel from the City Attorney and Chief of Police, and/or their designee.

The PPM and the City's Information Technology Director will share responsibility for the
placement of security cameras. In doing so, the camera position will be fixed at a pre-
determined field of view, although staff may alter the rate of zoom.
Network security, video and data storage, and other hardware/software functionality issues of
the security camera system will be the responsibility of the Information Technology Director.
IV. Storage, Retention, Access to Recordings
All security camera recordings shall be stored in a secure location for a period of no less than
30 days, and then will promptly be erased or written over, unless retained as part of a criminal
investigation or court proceedings or other bona fide use as approved by the PPM.
All City personnel are prohibited from using or disseminating information acquired from the
security camera system, except for official purposes.
All information collected through security camera recordings will only be released according
to law. The PSD shall maintain a log of all approved requests, from non-PSD
personnel/individuals, for access to, and/or copies of, security camera recordings. The log
shall include:
• Date of request;
• Date and time of recording;
• Identity of person requesting access;
• Purpose for which the access is necessary; and
• Whether a copy of the recording, or any piece thereof, was created.
V. Signage
All BPC parking facilities served by the security camera system will have signs displayed that
provide reasonable notification to users of the facility of the presence of security cameras.
Notification signs will be placed in conspicuous areas, in close proximity to the security
cameras. For buildings with interior cameras, this shall include, at a minimum, the placement
of signs at all primary building entrances. All such signs shall contain a notification that
cameras may or may not be monitored.
Suggested wording for signage:
"This area may be under video surveillance by the City of Bozeman."
