Further, given that the land owner is not a home builder and the complexity tracking the marketing and sales of the home we are requesting to meet the requirements of the Article 43 of Chapter 38 of the Bozeman Municipal Code per 38.43.140.B.1 Payment of Cash in Lieu. Further per 38.43.140.C.1 We are requesting that said Cash in Lieu be paid as a condition of approval for each phase of the development. Attached is the worksheet with the calculation for housing units subject to the Article 43 in each phase of the planned subdivision development. Given the impossibility of knowing the exact size and number of bedrooms of each home to be built in the subdivision we have assumed that two thirds of the duplex units will be 2-bedroom units and that all of the detached single-family home will have 3+ bedrooms. We believe affordable housing to be a community problem not a developer problem and view the fees proposed in the ordinance to be a development tax that may upon implementation not be enforceable. In the event the ordinance is challenged and implementation of the ordinance is blocked we will request a full refund of the Cash in Lieu paid. Sincerely, Gregory J.
