MEETING DATE: December 15, 2017 AGENDA ITEM TYPE: Action RECOMMENDATION: Direct City Manager to sign a Memorandum of Agreement (MOA) to establish a joint City-County committee to study and make recommendations on Law and Justice Center proposal options that could be scheduled for a June 5, 2018 election. RECOMMENDED MOTION: After listening to the presentations and taking public comment, I move to authorize the City Manager to sign the Memorandum of Agreement to establish a joint City-County committee to identify options for future use and project phasing on the Law and Justice Center site and to make recommendations to both commissions BACKGROUND: At their November 13, 2017 meeting, the City Commission considered a Land and Justice Center study presented by Thinkone Architects and unanimously passed the following motion: After taking public comment, I move to direct the City Manager to work with Gallatin County to formally reconvene a joint workgroup to develop options that address the critical facility and public safety needs of the City and County law and justice functions for consideration by both governing bodies, and explore other options and please come back. We also direct City staff to evaluate options for the provision of City services, including the Municipal Law & Justice Center and Fire. Pursuant to that action, the City Manager and County Administrator have discussed options for moving the project forward. Attached to this memo is a draft MOA that formally creates a joint committee comprised of elected officials and staff from both organizations. This committee will be tasked with evaluating the existing studies and plans for future use of the current L&J and proposed new criminal justice buildings on the campus. Missing in the Gallatin County/City of Bozeman Law and Justice Center Feasibility Study is careful consideration of the City’s needs for its Municipal Courts and Prosecution Division. City staff included in this committee will be able to advocate for the needs of these critical functions. 15 Page 2 of 2 UNRESOLVED ISSUES: The County report presented at the November 13, 2017 City Commission meeting contained four recommendations. According to the County Administrator, the County has discussed additional options that were not included in that report. A letter from the County Administrator dated November 28, 2017 asks the City to make a commitment now on partnering on a joint law and justice center to be done in phases with the first phase up for voter approval on June 5, 2018. Moving forward, if this is to be joint project, the City should be included in the development of all options. ALTERNATIVES: Many alternatives exist including reconsideration of a municipal police, fire and courts facility as directed by the City Commission. FISCAL EFFECTS: The approved FY18 budget does not include any money for further study or analysis of future options and we have not estimated what those costs might be. To move forward with further development of options, we could allocate money from the City Manager’s contingency fund or return to the Commission with a budget amendment. Attachments: Exhibit A: MOA Exhibit B: Letter from Jim Doar, November 28, 2017 Exhibit C: Letter to Jim Doar from City, November 17, 2017 Report compiled on: 11-30-17 16 p. 1 of 3 MEMORANDUM OF AGREEMENT REGARDING ESTABLISHMENT OF A JOINT COMMITTEE FOR EVALUATING OPTIONS FOR A JOINT LAW AND JUSTICE CENTER CITY OF BOZEMAN - GALLATIN COUNTY THIS MEMORANDUM OF AGREEMENT (MOA) is made and entered into this ___ day of __________, 2017, between Gallatin County, a political subdivision of the State of Montana, with principal offices at 311 West Main Street, Bozeman, Montana, 59715 (hereinafter referred to as “County”) the City of Bozeman, a self-governing municipal corporation of the State of Montana, with principal offices at 121 N. Rouse Ave., Bozeman, Montana, 59771 (hereinafter referred to as “City”). Collectively, the City and County are referred to as the “Parties.” WHEREAS, the City of Bozeman has identified significant space deficiencies for the Bozeman Police Department, Prosecutors, Victims Services, Records Retention and Municipal Court at the current Law and Justice Center site at 615 S. 16th Avenue; and WHEREAS, Gallatin County has identified similar space deficiencies for County Law Enforcement and District Court; and WHEREAS, the County and City have put facility proposals on past ballots that have not been approved by voters, most recently a joint project in November 2016; and WHEREAS, the County and the City understand that their cooperation in the development of public infrastructure is in the public interest; and WHEREAS, the County and City desire to identify a suitable alternative to those former plans for a joint facility by partnering to study, design and submit for voter approval a new joint City-County Law and Justice Center; and WHEREAS, the County and the City desire to enter into this MOA to establish the basic principles for which a joint committee will function. NOW, THEREFORE, the County and the City understand: 1. THE CITY AND COUNTY WILL ESTABLISH A JOINT COMMITTEE TO STUDY THE OPTIONS FOR A JOINT LAW AND JUSTICE CENTER. 2. THE CITY AND COUNTY WILL APPOINT MEMBERS TO THE COMMITTEE THAT WILL WORK TOGETHER, ALONG WITH NECESSARY DESIGNERS AND ENGINEERS, TO DEVELOP A FINAL PLAN FOR CONSIDERATION. 3. THE CITY AND COUNTY WILL WORK TOWARD A JUNE 5, 2018 ELECTION DATE FOR THIS PROJECT. 4. THE CITY AND COUNTY WILL CONSIDER PHASING THE PROJECT IF THAT BECOMES THE MOST FISCALLY RESPONSIBLE CHOICE FOR EACH PARTY TO MAKE. 17 p. 2 of 3 5. THE CITY AND COUNTY WILL BE EQUALLY INVOLVED IN MEETINGS AND DECISION-MAKING AND BRING INFORMATION BACK TO THE FORMAL CITY COMMISSION AND COUNTY COMMISSION FOR FINAL APPROVAL. 6. ANY EXPENSES GENERATED BY THE WORK OF THIS COMMITTEE WILL BE MUTUALLY AGREED UPON BEFORE THEY ARE COMMITTED TO; AND COSTS WILL BE SPLIT BASED UPON THE SQUARE FOOTAGE NEEDS OF EACH ENTITY. 7. REPRESENTATIVES. a. City’s Representatives: The City’s Representatives for the purpose of this MOA shall be Deputy Mayor Cyndy Andrus, City Manager Andrea Surratt, Assistant City Manager Chuck Winn, and Bozeman Police Chief Steve Crawford. b. County’s Representatives: The County’s Representatives for the purpose of this Agreement shall be Commissioner Steve White, County Administrator Jim Doar, Operations and Project Manager, Nick Borzak, and Sheriff Brian Gootkin. 8. NON-BINDING.
