1. 09:02:28 AM (00:00:14) 17381 Affordable Housing & Condominiums Text Amendment
(Matsen)
The proposed amendments will alter Article 38.43, Affordable Housing. These amendments, if
adopted, would make the requirements of Article 38.43 not applicable to condominium units.

09:03:52 AM (00:01:38) Martin Matsen, Community Development Director, explained that the
ordinance will eliminate all references to condominium developments out of the ordinance (including in
“market rate” definition).
09:04:35 AM (00:02:21) Matsen stated that the recommendation is to approve the ordinance revisions
to eliminate “condominium” referenced in the affordable housing section of the Code.
09:04:57 AM (00:02:43) Board member posed a question asking if there were any condominium projects
that were declined or fell apart as a result of the current language in the code.
09:05:09 AM (00:02:55) In response, Matsen explains there are a number of projects on hold until the
text amendment passes and takes effect. Matsen explained the process of how the text amendment
would take effect and the anticipated timeline.
09:06:07 AM (00:03:53) Board Member Stevenson asks if there is a proposed timeline for the review
process already in the works.
09:06:27 AM (00:04:13) Responding to Stevenson, Matsen explained that the next steps are to revise
the affordable housing manual that accompanies the affordable housing ordinance, and then revise the
ordinance with Commission direction to take a more structured approach to adding condominium units
back in to the ordinance. The City will try to identify the best way forward to identify new fee structure
to appropriately address condominium units in affordability. He explained the FHA criteria of approval
and eligibility for traditional financing opportunities is a critical component to the affordable housing
program and more structure and controls must be implemented to manage it.
09:09:21 AM (00:07:07) Board member posed a question of the proposed ordinance and the deletion of
language in 38.43.060.2 (percentage of AMI in two‐household dwellings) and asks if the language is now
incorporated in 38.43.070 or in a similar location, and why the deletion was included.
09:09:59 AM (00:07:45) Matsen explained that the language in the original ordinance was causing some
confusion. With the help of the Attorney’s Office, the new ordinance tries to eliminate that language
wherever it was deemed unnecessary to lessen the confusion. The language was not material to the
definition and so it was struck out.
09:11:43 AM (00:09:29) No public comment.
09:11:55 AM (00:09:41) Erik Garberg directed the meeting back to the Board members to make a
motion or start any discussion needed on the motion.
09:12:05 AM (00:09:51) MOTION to approve adopt the findings presented in the Staff Report of
Application 17381 to move recommended approval of the text amendment by Board member
Stevenson.
09:12:25 AM (00:10:11) MOTION SECONDED by Board Member George Thompson.
09:12:50 AM (00:10:36) VOTE: All in favor: Motion carries unanimously (3‐0). Action item closed.
09:13:17 AM (00:11:03) Matsen stated Application 17381 text amendment will be on the City
Commission agenda on October 2, 2017.
