WARRANTY DEED
FOR VALUE RECEIVED, JOHN P. SCULLY, TRUSTEE, the
grantor, of 222 East Main Street, Suite 301, Bozeman,
Montana, 59715, does hereby grant, bargain, sell, convey and
confirm unto THE CITY OF BOZEMAN, a municipal corporation,
as grantee, of P.O. Box 640, Bozeman, Montana, 59715, the
following described real estate, situate in the County of
Gallatin, Montana, to-wit:
PARCEL I: That portion of the abandoned Chicago,
'- Milwaukee, St. Paul and Pacific Railroad Company's
right of way located in the SElSEl of Section 13,
Township 2 South, Range 5 East, M.P.M., Gallatin
County, Montana, lying wi thin Kagy Boulevard in the
City of Bozeman, Montana. Said railroad right of way
is shown on that certain right of way and track map
filed 9-25-85 @ 11: 57 A.M. under Permanent File No.
770-C, in the office of the Clerk and Recorder for
Gallatin County, Montana. -

PARCEL II: That portion of the abandoned Chicago,
Milwaukee, St. Paul and Pacific Railroad Company's
right of way located within the NEl of Section 24,
Township 2 South, Range 5 East, M.P.M., Gallatin County
Montana, which is adjacent to Arnold Street as shown on
the plat of Figgins Addition (4th Phase) to Bozeman,
Montana, and which lies East of the centerline of the
former main track and is located between the South
right of way line (extended) of Arnold Street and the
North right of way line (extended) of Arnold Street.
Said right of way being shown on that certain right of
way and track map filed 9-25-85 @ 11: 57 A.M. under
Permanent File No. 770-C, in the office of the Clerk
and Recorder for Gallatin County, Montana.
PARCEL III: That portion of the abandoned
Chicago, Milwaukee, St. Paul and Pacific Railroad
Company's right of way and extra width properties in,
over and across the following described property:

Section 18--NWl SW1, NWl
Section 7--Portions of Lots H, I and K, Guy's 2nd
Addition to the City of Bozeman and that part ~f the
SWl SEl lying west of the centerline of Church Street
in the City of Bozeman.
EXCEPTING THEREFROM, any portion as described in those
certain QuitClaim Deeds recorded December 9, 1985, in

1283, inclusive; and that certain Quit Claim Deed
recorded December 9, 1985, in Film 90 of Deeds on Pages
1263 through 1264, inclusive, which was re-recorded
January 13, 1986, in Film 90 of Deeds on Pages 3261
through 3264, inclusive, records of Gallatin County,
Montana. Copies of said deeds are attached hereto and
made a part hereof.
ALSO EXCEPTING THEREFROM, the following described real
property, to-wit:
PARCEL I: That portion of the abandoned Chicago,
Milwaukee, St. Paul and Pacific Railroad Company's
right of way adjacent to Lot 6 of Greek Way Subdivision
to Bozeman, Montana, which lies North and West of a
line parallel to and distant 7, feet Northwesterly from
the centerline of the former main track, and which is
located between the South boundary line (extended) of
Lot 6 and the East boundary line (extended) of Lot 7 of
said subdivision. Said right of way being as shown on
that certain right of way and track map filed 9-25-85 @
11:57 A.M. under Permanent file No. 770-C, in the
office of the Clerk and Recorder for Gallatin County,
Montana.
ALSO EXCEPTING THEREFROM, the following described real
property,'to-wit:
That portion of the abandoned Chicago, Milwaukee,
St, Paul and Pacific Railroad Company's right of way
located in Section 7, Township 2 South, Range 6 East,
M.P.M., being adjacent to that tract of land being all
of Lot "G" and a portion of Lots "I", "H", and "K" of
Guy's Second Addition to Bozeman, Montana, according to
Certificate of Survey No. 494 which lies North and West
of a line parallel to and distant 7, feet Northwesterly
from the centerline of the former main track, and which
is located between the South boundary line of Section
7, Township 2 South, Range 6 East, M.P.M., and the
South boundary line (extended) of One Acre Lot 2 of
Guy's Second Addition to Bozeman, Montana. Said right
of way being shown on that certain right of way and
track map filed 9-25-85 @ 11: 57 A.M. under Permanent
File No. 770-C, in the office of the Clerk and Recorder
for Gallatin County, Montana,
TO HAVE AND TO HOLD the said premises, with their
appurtenances unto the said grantee, its heirs and assigns
forever, and the said grantor does hereby covenant to and
with the said grantee that he is the owner of said premises,
that they are free from all encumbrances except for
easements, restrictions and reservations of record, and that
he will warrant and defend the same from all lawful claims
whatsoever.
