WARRANTy DEED
FOR VALUE RECEIVED A. A. FROST and PAMELA S. FROST, husband
and wife, of 815 Blackmore Place, Bozeman, Montana 597157, the
grantors, do hereby grant, bargain, sell, convey and confirm unto
CITY OF BOZEMAN, a municipal corporation, Bozeman, Montana 59715,
the grantee, the following described property in Gallatin County,
Montana, to-wit:
Lot 8 in Block 5 of Graf's First Addition to
Bozeman, Montana, according to the official plat
thereof on file and of record in the office of the
County Clerk and Recorder of Gallatin County,
Montana.
Subject to easements, rights of way, conditions,
reservations and restrictive covenants of record
or which may be ascertained from a visual
inspection of the land, prior mineral and patent
reservations and exceptions, prior water rights,
taxes and other governmental charges and
assessments accruing on and after January 1, 1985.
TO HAVE AND TO HOLD the said premises, with their
appurtenances unto the said grantee, its heirs and assigns forever,
and the said grantors do hereby covenant to and with the said
grantee, that they are the owners in fee simple of said p~emises:
that they are free from all incumbrances except those no~ed above,

The following terms when used in this policy mean; in Schedule A and improvements affixed thereto which by law constitute
(a) "land"; the land described, specifically or by reference

4. Defense ond Prosecution of Ad19n5--Notlce of Clolm to be GI_n by the Insured '
(a) The Company, at its own cost pnd without undue delay shall provide 1) for the defense of the Insured in all liti9ation consisting
of actions or proceedings' commenced against the Insured, or defenses, resiraining orders, or injunctions interposed agoinst a foreclosure or
sale of the indebtedness secured by a mortgage covered by this policy or 0 sole of the estate or interest in said !and; or (2) for such action
as may be appropriate to establish the title of the estate or interest or the lien of the mortgage os insured, which litigation or action in any
of such events is founded upon on alleged defect, lien or encumbrance insured against by this policy, and may pursue any litigation to final
determination in the court of last resort. '
(b) In case any such oct ion or /-roceeding shall be begun, or defense interposed, or in case knowledge shall come to the Insured of
any claim of title or interest which is a verse to the title of the estate or interest or lien of the mortgage os insured, or which might COuSe
loss or damage for which the Company shall or may b. lioble by virtue of this policy, or if the Insured shall in good faith contract to sell the
indebtedness secured by a mortgage covered by this policy, or, if an Insured in good faith leases or contracts to sell, lease or mortgage the
same, or if the successful bidder at 0 foreclosure sale under a mortgage covered by this policy refuses to purchase and in any such event the
title to said estate or interest is rejected as unmarketable, the Insured shall notify the Company thereof in writing. If such notice sholl not be
given to the Company within ten days of the receipt of process or pleadings or if the Insured sholl not, in writing, promptly notify the Com-
pany of any defect, lien or encumbrance insured against which shall come to the knowledge of the Insured, or if the Insured shall not, in
writin9' promptly notify the Company of any svch rejection by reason of claimed un marketability of title, then all !lability of the Company in
regar to the subject matter of such action, proceeding or matter sholl cease and terminate; provided, however, the failure to notify sholl in
no case prejudice the claim of any Insured unless the Company shall be actually prejudiced by such failure and then only to the extent of
such prejudice.
(c) The Company shall have the right at its own cost to institute and prosecute any action or proceeding or do any other act which
in its opinion may be necessary or desirable to establish the title of the estate or interest or the lien of the mortgage os insured; and the
Company ma~ take any appropriate action under the terms of this policy whether or not it sholl be liable thereunder and shall not thereby
concede liabi ity or waive any provision of this policy.
(d) In all cases where this policy permits or requires the Company to prosecute or provide for the defense or any action or
proceeding, the Insured sholl secure to it the right to so prosecute or provide defense in such action or proceeding, and all appeals therein,
and permit it to use, at its option, the nome of the Insured for such purpose. Whenever requested by the Company the Insured shall give the
Company all assistance in any such action or proceeding, in effecting settlement, securing evidence, obtaining witnesses, or prosecuting or
defending such action or proceeding, and the Company shall reimburse the Insured for any expense so incurred.

This Commitment shall be effective only when the identity of the proposed Insured and the amount of the policy or
policies committed for have been inserted in Schedule A hereof by the Company, either at the time ofthe issuance ofthis
Commitment or by subsequent endorsement.
This Commitment is preliminary to the issuance of such policy or policies of title insurance and all liability and
obligations hereunder shall cease and terminate six (6) months after the effective date hereof or when the policy or
policies committed for shall issue, whichever first occurs, provided that the failure to issue such policy or policies is not the
fault of the Company. This Commitment shall not be valid or binding until countersigned by an authorized officer or agent.
IN WITNESS WHEREOF, the Company has caused this Commitment to be signed and sealed, to become valid when
countersigned by an authorized officer or agent of the Company, all in accordance with its By-Laws. This Commitment is
effective as of the date shown in Schedule A as "Effeptive Date."
CONDITIONS AND STIPULATIONS
1 . The term "mortgage," when used herein,shall in~UQIilc:leed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved
from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if
the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other
matter, the Company at its option may amend Schedule B ofthis Commitment accordingly, but such amendment shall
not relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions and
Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties
included under the definition of Insured in the form of policy or policies committed for and only for actual loss
incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to eliminate
exceptions shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this
Commitment. In no event shall such liability exceed the amount stated in Schedule A for the policy or policies
committed for and such liability is subject to the insuring provisions and the Conditions and Stipulations and the
Exclusions from Coverage of the form of policy or policies committed for in favor of the proposed Insured which are
hereby incorporated by reference and are made a part of this Commitment except as expressly modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may bring against the Company
arising out of the status of the title to the estate or interest or the status of the mortgage thereon covered by this
Commitment must be based on and are subject to the provisions of this Commitment.

EARNEST MONEY RECEIPT AND AGREEMENT TO SELL AND PURCHASE
Bozeman, Montana
June 14, 1985
RECEIVED FROM the City of Bozeman, hereinafter called
Purchaser, the sum of Five Hundred Dollars ($500) paid to
Sellers as earnest money in part payment of the purchase of
the following described real estate in the City of Bozeman,
County of Gallatin, State of Montana, to-wit:
Lot 8 in Block 5 of Graf's First subdivision
to the City of Bozeman according to the official
plat thereof now on file and of record in the
office of the Clerk and Recorder of Gallatin
County, Montana.
The total purchase price is Twenty-Five Thousand Three
Hundred Ninety-One and 13/100 Dollars ($25,391.13) payable
as follows:
(a) Five Hundred Dollars ($500) as earnest money
on the signing of this agreement.
(b) Twenty-Four Thousand Eight Hundred Ninety-One
and 13/100 Dollars ($24,891.13) in cash upon
delivery of the deed at the date at the
closing.
1. It is agreed that the Sellers shall, upon execution of
this agreement, seek the immediate termination of the
Temporary Restraining Order dated June 7, 1985, and
currently in force pursuant to an Order in the District
Court of the Eighteenth Judicial District of the State
of Montana, in and for the County of Gallatin, in Case
No. DV-85-455.
2. It is further agreed that the Sellers shall at their
expense furnish Purchaser with a title insurance policy
in an amount equal to the purchase price, insuring
title thereto vested in Purchaser, free and clear of
all liens and encumbrances except current taxes and
assessments.
3. The real property is to be conveyed by Warranty Deed,
free and clear of all encumbrances except current taxes
and assessments.

4. If Sellers' title is not merchantable or insurable and
cannot be made so within a reasonable time after
written notice containing statement of defects as
delivered to Sellers, then said earnest money herein
receipted for shall be returned to the Purchaser on
demand and all rights of Purchaser terminated unless
Purchaser waives said defects and elects to purchase.
5. If said title is merchantable or insurable and
Purchaser neglects or refuses to complete the purchase
or shall fail to pay the balance of the purchase price
as herein above provided, then said earnest money shall
be forfeited to the Sellers as liquidated damages and
not as a penalty, and this agreement thereupon shall be
of no further force or effect unless the Sellers elect
to enforce this agreement by requiring the Purchaser to
perform in accordance with the terms of this contract.
6. The Purchaser agrees that this contract does authorize
the Sellers to enforce the remedy of specific
performance. The Sellers agree that this contract does
authorize the Purchaser to enforce the remedy of
specific performance.
7. Purchaser agrees to assume the taxes and assessments
for the current tax year plus interest. (The Sellers
and Purchaser deducted Sellers' pro rata share of said
taxes and interest from the purchase price.)
8. Purchaser will pay for the recording of the deed.
9. Upon the completion of closing, Sellers agree that they
shall seek the immediate dismissal of the Complaint
dated June 7, 1985, filed in the District Court of
the Eighteenth Judicial District of the State of
Montana, in and for the County of Gallatin, as Case
No. DV-85-4S5.
10. The closing date of this sale shall be on or before
July 3, 1985.
11. Possession shall be delivered to Purchaser on date of
closing.

12. Purchaser enters into this agreement in full reliance
upon its independent investigation and judgment and
there are no verbal or other agreements which modify or
affect this agreement.
13. Time is of the essence of this agreement. The
agreement is binding upon the heirs, executors,
administrators, successors and assigns of each of the
parties hereto.
The City of Bozeman hereby agrees to purchase the
above-described real estate property at the firm price and
on the terms and conditions set forth above.
