WARRANTY DEED BOOf(
THIS INDENTURE, made the lOth day of March ,
1983, between NASH-SOURDOUGH PROPERTIES, a Montana general
partnership, of Bozeman, Montana 59715, Party of the First Part, and the City
of BOZEMAN, a Municipal Corporation, 411 East Main, Bozeman, Montana
59715-0640, Party of the Second Pa rt ,
WIT N E SSE T H:
FOR VALUABLE CONSIDERATION, the receipt and sufficiency of which is
hereby acknowledged, the Party of the First Part has granted and conveyed,
and by these presents does grant, bargain, sell, convey, warrant and confirm
unto the said Party of the Second Part and to its successors and assigns,
forever, the following described property, situated in Gallatin County, State of
Montana, to-wit:
A tract of land in the Southeast 1/4, Section 6, Township
3 South, Range 6 East, Principal Meridian Montana, Gallatin
County, Montana, and being more particularly described as
follows:
Beginning at the East one-quarter corner of said Section 6;
thence South 14001'2111 West, a distance of 2266.13 feet to the
true point of beginning; thence South, a distance of 200.00 feet
to the north-easterly corner of II Bozeman Water Works Tract No.
1;11 IIthence South 88043'5611 West, along IIBozeman Water Works
Tract No. 1,11 a distance of 444.66 feet; thence North 03033'0511
West, along IIBozeman Water Works Tract No. 1,11 a distance of
200.11 feet; thence North 88043'5611 East, a distance of 457.06
feet to the true point of beginning.
Said tract as herein described contains 2.0696 acres and is
depicted on Certificate of Survey No. 633-A on file and of
record in the office of the Clerk and Recorder of Gallatin
County, Montana.
Said tract of land previously shown as a portion of Tract 4 of
Certificate of Survey No. 633 is being added to II Bozeman Water
Works Tract Number One,1I as filed in Book 97, page 625 of the
Gallatin County Clerk and Recorder's Records, for the purpose
of transferring that portion of Tract 4 to II Bozeman Water Works
Tract Number One, II as filed in Book 97, page 625 of the
Gallatin County Clerk and Recorder's Records, as part of a
realignment of common boundary, and does not create a
separate parcel of land capable of future transfer by this legal
description.
TO HAVE AND TO HOLD, all and singular the said premises, together
with the appurtenances unto the said Parties of the Second Part, and to its
successors and assigns, forever.
AND the said Party of the First Part, and its successors, do hereby.
covenant that they wi II forever WARRANT and DEFEND all right, title, and
interest in and to the said premises and the quiet and peaceable possession
thereof, unto the said Party of the Second Part, and to its successors and
assigns, against all and every person and persons whomsoever lawfully
claiming or to claim the same.
I N WITNESS WHEREOF, the said Party of the First Part has
executed this instrument the day and year first above written.

the partnership NASH-SOURDOUGH PROPERTIES executed the same.
