Harrison - 4149 Clydesdale Court CUP for Cooperative HousingFrom:Shawn Harrison To:Chris Saunders; Agenda Cc:sharrison.mt@gmail.com Subject:Public Notice for 4149 Clydesdale Court File 17-469 ; Public Hearing: November 20th at 6pm Date:Monday, November 20, 2017 12:29:40 PM Hi Chris et al, I am unable to attend tonight’s hearing but wanted to email my opposition to the Conditional Use Permit (CUP) that has been applied for at the 4149 Clydesdale Court location. I served as the President of the Baxter Meadows Master Association for 3 + years and worked extremely hard with the community , developers, and the city to protect our covenants and community standards and feel it is now become an exception example for the city with great mixed use along with single outstanding open space and single family homes. I live on Arabian Ave and back of my property faces the property in question and Riata. There are a number of personal reason why I think this a bad idea and not within the spirit of what Bozeman nor Baxter Meadows community is trying to build long term. For example, I would like to live in Triple Tree or Yellowstone club but I simply cannot afford it. Our family had to start in a starter home and work our way up and invest in our current home in Baxter Meadows. This is a significant investment for me and my family that I did with the expectations that the covenants would be adhered to and enforced. But I will stick to the key facts as to why this could set dangerous standard that could impact our entire Baxter community as well as throughout similar communities Bozeman. (1) Fundamentally this does not meet the key requirements (i.e. parking) or intent for a CUP and I do not see a single compelling reason they city would approve this filing. The families just want to live together. Not a reason for a CUP. In fact I have not heard a signal compelling reason this should even be remotely considered. (2) This CUP does not promote affordable housing nor do I believe this situation be covered by Fair House Act. This is a high end home ($600k+ in the Estate lots) of a mixed use community with many other options that these families could have purchased in Baxter and within Bozeman. In fact, based on a quick search of MLS there are 36 available listing that would accommodate families of this size within Bozeman city limits that are $300k or less that these families could have purchased. (3) The applicants we fully aware the single family home requirements and the Baxter Meadows Master Association covenants etc.… and totally ignored them. Approving this would open the door for anyone to disregard and ignore covenants for all communities. They would be paying less per family for Property Taxes, HOA dues etc… (4) Finally, the most compelling reason I think this should not be approved is that City has allowed Riata to be closed off and maintained as a private road with no sidewalks or parking to accommodate the number of folks they have coming in and out of their home for youth ministry gathering etc.…. The number of folks writing for approval (all from outside our community) is a good indication of how many will be frequently this establishment if approved. Also, this is right across from Chief Joseph Middle School and this is a danger to all family and kids going to and from school community that used that road to walk and bike to school. If the city were to approve this I would hope with the contingency that the applicants fund the rebuilding of Riata and installing sidewalks etc.… Thanks for your consideration and I hope you make the correct decision to REJECT this application as it is clearly that is best interest of Bozeman and the Baxter Meadows community.
