Hello Chris,
First, congratulations on being voted in our future Mayor. As you know, there are many
issues to be tackled by the City Commission in the coming months/years. One issue that the
city commission will be discussing tonight, causes us great concern. The City is reviewing a
“Conditional Use Permit” to allow 2 families to live in one home under a “Cooperative
Housing” arrangement. The home is located @ 4149 Clydesdale Court in Baxter Meadows .
The home was purchased by 2 individual families who plan to modify the home from a single
family residence to a multi-person residence. Please be advised that the Baxter Meadows
covenants do not allow for ‘cooperative housing’ arrangements and mandate each home be a
single family residence.
The staff report indicates, at the time of writing the report, 37 public comments were
received. At that time, most comments were favorable and it appears the people submitting
the comments personally know the 2 families requesting the CUP and do not reside in Baxter
Meadows. The notice of the CUP has been circulated to all owners in Baxter Meadows and
many have been discussing this subject, and most, if not all involved in the conversation, are
opposed to the CUP. Those of us who own homes in Baxter Meadows, have a significant
investment in our homes and our neighborhood and did our due diligence prior to purchasing
our homes, in reviewing the covenants and know that BM is established for single family
residences. Please be advised that there is are conflicts between the City Ordinance and the
more restrictive, BM HOA Covenants.
If approved by the City, this will be the very first “cooperative housing” household allowed in
the City and will be precedent setting for all Bozeman neighborhoods. This is not a “Baxter
Meadows” issue. It IS an issue that will effect all neighborhoods in the city and will have
potential conflicts with those respective neighborhood covenants. It is very important that
the City practices an appropriate level of deliberation given the potential effects on all
Bozeman neighborhoods, including the downtown historical district. We ask that you pause
and seriously consider all the impacts this type of arrangement will have on our City.
We have reviewed the application and are strongly against the City approving this application.

RE: Public Notice for CUP - Court File 17-469 - 4149 Clydesdale Court
To whom it may concern,
We are responding to the CUP application filed for the property located at 4149
Clydesdale Court. We are strongly opposed to the approval of this permit. We are
homeowners in the Baxter Meadows Subdivision and are very concerned that
allowing ‘cooperative housing’ in our subdivision will have a negative financial impact
on our property values and on our neighborhood. Baxter Meadows is zoned
Residential Single Unit, i.e., single family home. Baxter Meadows is an established
and highly desired neighborhood in Bozeman. When a buyer signs a Buy/Sell
Agreement to purchase a property, buyers are required to perform due diligence of
the property, which includes a review of the neighborhoods’ covenants and by-laws.
These factor into a buyer’s decision to purchasing the property. The covenants in
Baxter Meadows state that homes are designated for separate, individual ownership
only. Our covenants specifically define “Residential Units” as “any Unit or lot primarily
intended or zoned for residential uses, including, Units where any residential
condominium units have the right to be created or have been created; Units where
apartments have the right to be created or have been created; and Units where a
single family home or other property for individual occupancy has the right to be
created or has been created”.
It will be harmful and damaging for all homeowners in the Baxter Meadows
subdivision if the City of Bozeman approves the CUP allowing ‘cooperative housing’
as requested in this application. We strongly encourage the City of Bozeman to
support the existing homeowners and landowners by disapproving the CUP request.
