My wife and I currently reside in Texas but own the property, 4197 Clydesdale Court, which is next door to 4149 Clydesdale Court. We are protesting the Kirby / Radoslovich petition for CUP. I find it interesting that so many members of the community who do not reside in Baxter Meadows choose to write letters on behalf of the Radoslovich / Kirby families. There is of course no negative affect to them personally so it is quite easy for them to vote in favor of the CUP. I wonder if they would be so willing if they stood a chance of losing value in their property or were inconvenienced as a result. It’s always a different situation when you are the one’s negatively affected. I ask, can anyone of them guarantee that my property value won’t suffer as a result? I can tell you with 100% confidence I would not purchase a property next door to a home where multiple families are cohabitating under one roof. Will the city or the Radoslovich / Kirby families compensate their neighbors as property values go down or sales fall through? This type of situation goes completely against the legal definition of a single family home or R-S as the city defines the zoning at this location. The situation at hand is not a popularity contest based on the character of these individuals. It’s not about reducing fuel consumption or traffic. It’s about whether or not the city will protect its citizens and their property by upholding the laws, codes, and covenants set forth. If this CUP is accepted there will undoubtedly be a precedent established that will forever change the standards in which single family residences are defined in Bozeman. It may be your neighborhood next. The majority of the residence in the designated single family zone have worked a good portion of their lives to afford the luxuries of having more space, bigger yards, quieter neighborhoods, and larger square footage. It’s not a right afforded to anyone it’s earned. If they haven’t done enough to earn it then my suggestion is to keep working hard until it can be achieved without “conditions”. Providing this CUP sends the wrong message that the government owes these families a shortcut to something they haven’t yet earned.
