I am writing today to state my opposition to the conditional use permit as requested in
File 17-469. One of the reasons my husband and I chose to purchase a single family
home in the Baxter Meadows West neighborhood five years ago was that we wanted
a community within other single family homes. Not duplexes, multi-family, or shared
two family communal living. This area is zoned for single family homes. It is my
belief that the city would be in error to allow this CUP for two unrelated separate
married couples with two separate sets of children to split the ownership and title
to occupy a single dwelling when it is zoned as RS, residential single unit, which
means that homes here are designed for a single family group not several groups
residing under one roof. It is my understanding that City zoning laws were developed
to provide assurance to homeowners that their neighborhoods will remain zoned as
they were intended. As a homeowner, I expected zoning laws to protect my property
rights. What is the point of having zoning laws if they are not followed? If this is to
go through, I believe the city will be in error and not acting within the law. If the
City doesn’t stand behind its laws, what is stopping my husband and I from deciding
that we’d like to make the upper level of our home into another complete residential
living space? Then putting our home up for sale as a two unit house?
We chose to live in the City because I expected the zoning laws to protect our
property rights. The homes in Baxter Meadows West are zoned for single family
homes, not duplexes or multi-family. So, I believe the City zoning laws should
prohibit this conditional use permit.
