I am emailing you with regards to the Conditional Use Permit (CUP) that has been applied for at the 4149 Clydesdale Court location File 17-469.
I live at 4140 Clydesdale Court and I am writing to you in hopes that you deny their application for a Conditional Use Permit. I have lived in Baxter Meadows for over 10 years (2 different
homes) and have always been attracted to how well the neighborhood is maintained and codes are enforced. We chose to live in this neighborhood because it is zoned for RS Single family
Households and the city has been strict about the variances that have been requested. Making a special variance for them will allow this for potential buyers to do the same thing and
change the integrity of the development as well as open a can of worms for future buyers.
As current Residences of Baxter Meadows it is with great belief in the purpose of the commissions to preserve and protect the interests and investment of the individual owners. Having
two families, or any combination thereof, given the option to reside in a single household by our commission is very concerning and disheartening. The residential use policy makes
multiple mentions of a "single family" as well as the RS Designated Zoning III.C.RS, which specifically states "One single family". It is my understanding that the intent and purpose of the R-
S residential suburban district zoning designation is to allow for open space, resource protection, and be comprised of primarily single-households for circumstances where environmental
constraints limit the desirable density.
Since the closing of Baxter Lane between Harper Puckett and Ferguson, we have seen so much traffic through our neighborhood that as affected the safety and has impacted our
neighborhood immensely. Natural wear and tear in a Residential Community and infrastructure when two distinct families, totaling 10 people, reside in a single family residence and an
area specifically zoned as single family dwelling. I have witnessed and documented since the purchased of the property that over a period of 30 days that a majority of the time (more
than 50%) there are at least 1-4 additional cars parked in the cul de sac or driveway, not counting the 2 cars owned by the current occupants. Last night here were 9 cars parked along
Riata Rd and individuals were walking over to 4149 as if they were hiding the fact they were going into the home. This is very sketchy as a Residence of that Cul-de-sac. They had young
guest that were driving too fast and they were piling people into their home. This is just something visual and easy to notice, but over a prolonged period of time and an addition of
another family of 5 people (a family of 5 currently resides at location) set to move into the house, my heightened added concern also lies within the effects of increases in water, sewage,
garbage, and other services and impacts on the communities and cities infrastructure.
Bozeman City code defines a household (Sec. 38.42.1420) not more than four unrelated people. By my understanding, any one individual living at the location will not be related to at
least five other occupants. Thus, I believe the reason for the needed Conditional Use Permit. Section 38.19.110 defining criteria for a Conditional Use Permit, subsection E1 requires
adequate parking and E2 states that there be no material adverse effect on abutting properties. Attachment are multiple photos showing more than four vehicles parked in the cul de sac
(2 illegally) and one vehicle pulling out of the driveway. Potential future residents will have four vehicles at the location designed for two and the material adverse effect is carried by all
abutting neighbors. The home only has a 2 car garage. These two quick instances are proof of non-compliance for the Conditional Use Permit.
Bozeman is a wonderful place to live and is a desirable place for people to move to. Setting the precedent of the possibility that two families can share the purchase, taxes, and costs
while living together in a single family dwelling sends the wrong message. Do we need portray to potential Bozeman residents that they can afford more (more incomes) driving up prices
on homes, but paying less in taxes (2 families/one property), and the community will share the burden of impacted infrastructure (more vehicles/more water/more garbage/more sewage,
more electricity/ more wear and tear)? They could have easily purchased Qty: 2 $300,000 homes right next to each other nearby in the New Subdivision in Flanders Mill.
It is my hope that you would understand my concern and choose to protect our Baxter Meadows community and deny their request.

Here is a photo of an average day at 4149 Clydesdale. Cars parked the wrong way on the street, cars not parked in their own driveway. All of these cars are from the 2 families that live
there except for the one pulling out of the garage.
