WARRANTY DEED
COUNTRY CLASSIC DAIRIES, INC. , d/b/a Darigold, a IYbntana Corporation, of
post office address Box 968, Bozeman, Montana 59771-0968, herein referred to as
Grantor, whether one or more, in consideration of ONE DOlLAR and other valuable
considerations, does hereby grant, warrant and confirm unto THE CITY OF BOZEMAN,
of post office address Box 640, Bozeman, Montana 59771~0640, herein referred to
as Grantee, whether one or more, and to Grantee's heirs and assigns forever, all
of the following real property in Gallatin County, Montana:
A tract of land being a portion of Lots 5, 6 and 7, Block 3, Durston' s
Second Subdivision, according to the official plat thereof on record in
the office of the County Clerk and Recorder of Gallatin County, located
wi thin the Southeast Quarter of Section 1, TCW1ship 2 South, Range 5
East of the Principal Meridian of Montana, City of Bozeman, Gallatin
County. Montal1a, and being furt..l1er described as follows: BEGIl\lNJNG at
the Northeast corner of said Lot 7. Thence South 00000' 00" West along
the east line of said Lots 5, 6, and 7, a distance of 193,50 feet;
thence North 89056' 17" West a distance of 10.00 feet; thence North
00000' DO" East a distance of 77.00 feet; thence North 89056'17" West a
distance of 55.28 feet; thence NorthOOoOO'(j}7" East a distance of 117.26
feet to a point on the North line of said Lot 7; thence South 89016' 02"
East a distance of 65.28 feet along the North line of said Lot 7 to the
point of beginning. Said tract of land being 8,400 square feet ( .193
acres) , and shown on Amended Plat E- 33A as Lot 7A. SUBJECT to
easements, conditions, restrictions and rights-of-way shown or indicated
in the public records or plats filed and recorded in the office of the
County Clerk and Recorder of Gallatin County, Montana, or which may be
ascertained from a visual inspection of the land, including ditch and
utility easements. SUBJECT to prior mineral and patent reservations and
exceptions, if any; SUBJOCI' to taxes and other governmental charges and
assessments accruing or imposed after the date hereof. TOGETHER with
all tenements, hereditaments and appurtenances thereto, and all
reversions and remainders, and all rents, issues and profits thereof,
and all right, title and interest of the Grantor therein,
TO HAVE AND TO HOLD all and singular the said premises together with
appurtenances unto the Grantee and to Grantee's heirs and assigns forever.
Grantor does hereby warrant and agree to defend all right, title and
interest in and to said property, and the quiet and peaceful possession thereof,
unto the Grantee and the Grantee's heirs and assigns forever, against all acts
of said Grantor and any and all persons who may lawfully claim the same.
