WARRANTY DEED
THIS INDENTURE, made this 18th day of Apri' , 199L:
IN CONSIDERATION OF THE SUM OF $ 10.00 (or a.v.C) lawful money of the United
States to them in hand paid by the CITY OF BOZEMAN, the receipt whereof is hereby
acknowledged, WITNESSETH THAT,

does hereby GRANT, BARGAIN, SELL, CONVEY, WARRANT AND CONFIRM unto the
CITY OF BOZEMAN for the benefit and use of its Engineering Department the following
described real property, to-wit:
A tract of land located in the NW % of Section 19. T2S, R6E, P.M.M.. Gallatin
County. Montana, and being further described as follows: Beginning at the
northwest corner of said Section 19: thence along the north line of said section East
45.00 feet: thence parallel with the west line of said Section 19 south 165.00 feet;
thence parallel with the north line of said Section 19 west 45.00 feet to a point on the
west line of said Section 19: thence along said line north 165.00 feet to the point of
beginning. Said tract being 7.425 square feet along with and subject to any existing
easements.;
AS SHOWN by Exhibit "A", consisting of one sheet, attached hereto and made a part hereof.
EXCEPTING AND RESERVING, however, all gas and oil, beneath the surface of the above-
described and conveyed premises, together with the right to extract the same, provided that in
the exercise of such right the surface thereof shall not be disturbed, interfered with, or in any way
damaged.
FURTHER EXCEPTING AND RESERVING unto the grantors, their successors and assigns
all water, water rights, ditches, canals, irrigation systems, existing or as relocated, if any, including
but not limited to, water stock or shares, bonds, certificates, contracts and any and all other
indicia, of water, water right and ditch ownership, or any interest therein, appurtenant to the land
described herein.
TO HAVE AND TO HOLD the above described and conveyed premises, with all the
reversions, remainders, tenements, hereditaments and appurtenances thereto, unto the CITY OF
BOZEMAN, and to it successors and assigns forever.

1. IN CONSIDERATION OF THE PAYMENTS HEREIN SET FORTH AND THE
SPECIFIC AGREEMENTS TO BE PERFORMED BY BOTH PARTIES HERETO AND
WRITTEN IN THIS AGREEMENT, THE PARTIES HERETO BIND THEMSELVES TO

EXHIBIT "A" (List acres and/or sq. ft. and improvements in the
taking. )

Temporary construction permit: none
3. TOTAL COMPENSATION $10.00
4. IT IS UNDERSTOOD AND AGREED THE CITY SHALL MAKE THE FOLLOWING
DISBURSEMENT OF PAYMENT.
A warrant in the amount of S10.00 to be made
payable to Martha Strain Weaver and mailed to Martha
Strain Weaver. 2308 South Third, Bozeman. MT 59715
5. IT IS UNDERSTOOD AND AGREED THE work area will be leveled and
cleared of any debris after construction and left in a good,
workmanlike condition.
6. IT IS UNDERSTOOD AND AGREED THAT the existing driveway
approach for 2308 South Third will remain essentially the same
after the completion of the improvements to South Third in
regards to the width and grade of the approach.
