HomeMy WebLinkAboutOrdinance 05- 1653 Amending City Zone Map ORDINANCE NO. 1653 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP FROM "M-1" (LIGHT MANUFACTURING DISTRICT) TO "B-1" (NEIGHBORHOOD COMMERCIAL DISTRICT) ON 7.78 ACRES AND ESTABLISHING AN INITIAL ZONING OF "R-1" (RESIDENTIAL SINGLE-HOUSEHOLD, LOW DENSITY DISTRICT), "R-2" (RESIDENTIAL TWO-HOUSEHOLD, MEDIUM DENSITY DISTRICT), "R-3" (RESIDENTIAL MEDIUM DENSITY DISTRICT) AND "R-O" (RESIDENTIAL OFFICE DISTRICT) ON 35.99 ACRES, ON PROPERTIES LOCATED IN THE NW% OF SECTION 35, T1S, R5E, PMM, CITY OF BOZEMAN, GALLATIN COUNTY, MONTANA. WHEREAS, the proposed zone map amendment to amend the City of Bozeman Zone Map from "M-1" (Light Manufacturing District) to "B-1" (Neighborhood Commercial District) on 7.78 acres and establishing an initial zoning of "R-1" (Residential Single-Household, Low Density District), "R-2" (Residential Two-Household, Medium Density District), "R-3" (Residential Medium Density District) and "R-O" (Residential Office District) on 35.99 acres, has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on June 1 , 2004, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, upon a vote of 3-0 the Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved as proposed; and WHEREAS, after proper notice, the City Commission held its public hearing on June 7, 2004, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C,A., and found the proposed zone map amendment to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on June 7, 2004, the City Commission found that the proposed zone map amendment would be in compliance with Bozeman's adopted growth policy and would be in the public interest; and WHEREAS, the subject property was annexed through adoption of Commission Resolution No. 3867, adopted on the 17th day of October, 2005. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby designated as "R_1" (Residential Single-Household Low Density District): Beginning at the point hereinbefore referred to as Point A; thence North 89045'15" East, along the north line of said Tract 1, a distance of 639.38 feet to a point to be hereinafter referred to as Point D; thence South 00013'52" West, a distance of 663.41 feet; thence North 89046'08" West, a distance of 109.67 feet; thence South 00013'52" West, a distance of 168.20 feet to a point to be hereinafter referred to as Point C; thence South 89044'23" West, along the north line of the plat of Cattail Creek Subdivision, Phase 2, a distance of 420.02 feet; thence North 00013'52" East, a distance of 171.80 feet; thence North 89046'08" West, a distance of 109.68 feet to a point to be hereinafter referred to as Point B; thence North 00013'52" East, a distance of 658.09 feet to the Point of Beginning. Said parcel containing 11.34 acres more or less. Section 2 That the zoning district designation of the following-described properties is hereby designated as "R-2" (Residential Two-Household Medium Density District): Parcel 1 Beginning at the point hereinbefore referred to as Point B; thence South 89046'08" East, a distance of 109.68 feet; thence South 00013'52" West, a distance of 171.80' to a point on the north line of the plat of Cattail Creek Subdivision, Phase 2; thence South 89044'23" West, along said north line, a distance of 109.68 feet; thence North 00013'52" West, a distance of 172.74 feet to the Point of Beginning. Said parcel containing 0.43 acres more or less. Parcel 2 Beginning at the point hereinbefore referred to as Point C; thence North 00013'52" East, a distance of 168.20 feet; thence South 89046'08" East, a distance of 109.67 feet; thence South 00013'52" West, a distance of 167.26 feet to a point on the north line of the plat of Cattail Creek Subdivision, Phase 2; thence South 89044'23" West, along said north line, a distance of 109.67 feet to the Point of Beginning. Said parcel containing 0.42 acres more or less. Section 3 That the zoning district designation of the following-described properties is hereby designated as "R-3" (Residential Medium Density District): Parcel 1 Beginning at the northwest corner of said Section 35; thence North 89045'15" East, along the north line of said Tract 1, a distance of 285.85 feet to a point to be hereinafter referred to as Point A; thence South 00013'52" West, a distance of 830.83 feet to a point on the north line of the plat of Cattail Creek Subdivision, Phase 2; -2- thence South 89044'23" West, along said north line, a distance of 284.74 feet; thence North 00009'17" East, along the west line of said Tract 1, a distance of 830.89 feet to the Point of Beginning. No. 2034523; thence South 00013'52" West, along the west line of said parcel, a distance of 429.57 feet; thence North 89046'08" West, a distance of 20.50 feet; thence North 00013'52" East, a distance of 429.40 feet to the Point of Beginning. Said parcel containing 0.20 acres more or less. Section 5 That the zoning district designation of the following-described property is hereby designated as "B-1" (Neighborhood Business District): Commencing at the north quarter corner of said Section 35; thence South 00013'52" West, a distance of 830.23 feet to the northeast corner of the plat of Cattail Creek Subdivision, Phase 1, and the Point of Beginning; thence South 00013'52" West, along the east line of said plat, a distance of 785.10 feet; thence North 89046'08" West, along the south line of Lot 2 Block 4 and its westerly extension a distance of 432.50 feet; thence North 00013'52" East, along the centerline of North 2rh Avenue a distance of 781.39 feet to a point on the north line of said plat; thence North 89044'23" East, along said line a distance of 432.52 feet to the Point of Beginning.
