COMMISSION RESOLUTION NO. 3865
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, IDENTIFYING SPECIAL USERS OF THE CITY OF BOZEMAN
LANDFILL AND ESTABLISHING SPECIFIC WAIVERS OF CITY OF BOZEMAN
LANDFILL TIPPING FEES, EFFECTIVE OCTOBER 30, 2005.
WHEREAS, on the 12th day of September 2005, the City Commission determined that the
construction of a solid waste transfer station was not in the best interests of the public at this time; and
WHEREAS, on the 3rd day of October 2005, the City Commission did adopt Commission
Resolution No. 3860, affirming the types of waste permitted; determined that the landfill gate fees
established by Commission Resolution No. 3468 are still appropriate and in the best interests of the City
of Bozeman; and determined that in order to extend the life of the City of Bozeman Landfill Class II cell for
the convenience of City of Bozeman residents, the City of Bozeman Landfill shall be open to City of
Bozeman non-commercial residents only for the purpose of disposing of acceptable household waste.
Commercial garbage trucks, commercial pickup trucks and trailers, roll-off construction or garbage
containers, construction loads and demolition materials, and non-city residents will not be allowed to utilize
the City of Bozeman Landfill. Acceptable household waste is defined as "household garbage with
occasional mix of construction waste"; and
WHEREAS, the City of Bozeman Landfill has previously provided free services to certain non-
profit groups, governmental entities, and various community functions; and
WHEREAS, in order to extend the life of the City of Bozeman Landfill Class II cell for the
convenience of City of Bozeman residents, the amount of waived tipping fees must be limited to certain
non-profit organizations located within the City of Bozeman. Further, certain governmental entities and
community events should be allowed to continue to use the City of Bozeman Landfill at no charge to
ensure adequate protection of health, safety and welfare, and in recognition that these functions are true
community events.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
The City of Bozeman shall waive tipping fees at the City of Bozeman Landfill Class II cell for the
following until the landfill closes:
1. Sacks of Bozeman;
2. Salvation Army of Bozeman;
3. Gallatin Valley Food Bank;
4. Landfill Cover Material (i.e., clean dirt, street and parking lot sweepings):
These items are used as daily cover of the cell, and will continue to be accepted free
of charge.
5. Gallatin County Road and Bridge Department; State of Montana
Department of Transportation; State of Montana Department of Fish, Wildlife
and Parks; Clean Up Bozeman Day; and City of Bozeman Street and Parks
Divisions: waived tipping fees for street sweepings, fall and spring street and parks
cleanup, dead animals, and roadside trash.
6. Bozeman community events open to the general public, such as Bite
of Bozeman, Music on Main, Christmas Stroll: waived tipping fees for garbage
totes provided by the City of Bozeman Solid Waste Collection Division.
Section 2
The City of Bozeman shall be allowed to continue to dispose of solid waste collected from all
City of Bozeman owned and maintained public parks at the City of Bozeman Landfill. Tipping fees will not
be waived.
Section 3
The provision of waived tipping fees or usage privileges at the City of Bozeman Landfill by the
above-referenced organizations, governmental entities. and community events shall become effective
October 30, 2005.
PASSED AND ADOPTED by the City Commission of he City of Bozeman, Montana, at a regular
session thereof held on the 17th day of October 2005. '
