To whom it may concern,
We are responding to the CUP application filed for the property located at 4149
Clydesdale Court. We are strongly opposed to the approval of this permit. We are
homeowners in the Baxter Meadows Subdivision and are very concerned that allowing
‘cooperative housing’ in our subdivision will have a negative financial impact on our
property values and on our neighborhood. Baxter Meadows is zoned Residential Single
Unit, i.e., single family home. Baxter Meadows is an established and highly desired
neighborhood in Bozeman. When a buyer signs a Buy/Sell Agreement to purchase a
property, buyers are required to perform due diligence of the property, which includes a
review of the neighborhoods’ covenants and by-laws. These factor into a buyer’s
decision to purchasing the property. The covenants in Baxter Meadows state that
homes are designated for separate, individual ownership only. Our covenants
specifically define “Residential Units” as “any Unit or lot primarily intended or zoned for
residential uses, including, Units where any residential condominium units have the right
to be created or have been created; Units where apartments have the right to be
created or have been created; and Units where a single family home or other property
for individual occupancy has the right to be created or has been created”.
It will be harmful and damaging for all homeowners in the Baxter Meadows subdivision
if the City of Bozeman approves the CUP allowing ‘cooperative housing’ as requested in
this application. We strongly encourage the City of Bozeman to support the existing
homeowners and landowners by disapproving the CUP request.
