Approve Beer and Wine Licenses Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Mike Maas, Licensing Clerk Laurae Clark, City Treasurer Kristin Donald, Finance Director SUBJECT: Approval of the Off-Premise Beer and Wine License for Sparky Boy Enterprises, dba Planet Natural, the On-Premises Beer and Wine License for Montana Theatreworks, and the On-Premises Beer and Wine License for Equinox Theatre dba Verge Theater for calendar year 2017 MEETING DATE: November 6th, 2017 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve an Off-Premise Beer and Wine License for Sparky Boy Enterprises, dba Planet Natural 1251 N. Rouse Ave, the on-premises beer and wine license for Montana Theatreworks 17 W. Main St., and the Equinox Theatre dba Verge Theater 2304 N. 7th Ave for calendar year 2017. They have complied with state laws and have completed the City’s application process as required. BACKGROUND: Sec. 4.02.030. - City license required; application; license fees. A. No person shall manufacture or sell alcohol in the city, under the provisions of the Montana Alcoholic Beverage Code, or at all, without first procuring a license to do so from the city. B. The application shall be filed with the city clerk and presented for the consideration of the commission. The commission may, in its discretion, postpone any action for investigation or other good cause. The action of the commission with reference to the application shall be recorded in the meeting's minutes. C. If the application is rejected, the reasons must be noted in the minute entry, the applicant notified, and the tendered fee returned. D. License fees must be payable in advance and shall accompany the application therefore, whether original or renewal. All licenses under this article will expire at 12:00 midnight of December 31, in the year for which such license is issued. In the event that a license is granted after June 30 of any year, the license fee will be one-half of the entire yearly license. Sparky Boy Enterprises dba Planet Natural has met all application requirements and paid for their license on August 15, 2017. However, due to an administrative lapse during employee turnover, their application was never submitted for approval to the Commission. 14 Montana Theatreworks operates the Ellen Theatre. They were unaware they needed a city license to accompany their Non-Profit Arts license from the state. Upon becoming informed they returned their application materials the next day. Equinox Theatre operates the Verge Theatre. They were unaware they needed a city license to accompany their Non-Profit Arts license from the state. Upon becoming informed they returned their application materials the next day. FISCAL EFFECTS: Accept payments totaling $1000.00 for 2017 licenses. ALTERNATIVES: As suggested by the City Commission.
