ORDINANCE NO. 1325
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, ADOPTING BY REFERENCE THE SECOND
PRINTING OF THE UNIFORM CODE FOR BUILDING CONSERVATION,
COPYRIGHTED 1987, WITH CHAPTERS 4, 5, AND 7 DELETED
THEREFROM EXCEPT AS REFERENCED BY CHAPTER 6 - HISTORIC
STRUCTURES, REGULATING THE MINIMUM STANDARDS FOR CHANGE
OF OCCUPANCY, ALTERATION OR REPAIR OF EXISTING
BUILDINGS AND STRUCTURES AND ESTABLISHING A PENALTY FOR
VIOLATION THEREOF.
Preamble
The purpose of this code is to encourage the
continued use or reuse of legally existing buildings
and structures. The provisions of this code shall
constitute the minimum standards for change of
occupancy, alteration or repairs of existing buildings
and structures within this jurisdiction.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA:
That a new Section be enacted into law as a Chapter of Title 15
of the Bozeman Municipal Code to read as follows:
Section 1.
Adoption by reference of the Uniform Code for Building
Conservation, 2nd Printing, copyrighted 1987.
That a certain document, one (1) copy of which is on file
and is open for inspection by public in the office of the City
Clerk of the City of Bozeman, 411 East Main Street, Bozeman,
Montana, being marked and designed as: Uniform Code For Building
Conservation, 2nd Printing, copyrighted 1987, published by the
International Conference of Building Officials, excluding
Chapters 4, 5, and 7 except as referenced by Chapter 6 - Historic
Structures a copy of which is attached hereto as Exhibit A and
incorporated by this reference as though fully set forth herein,
be and the same are hereby adopted as the code of the
jurisdiction of the City of Bozeman for regulating the minimum
standards for change of occupancy, alteration or repair of
existing buildings and structures in the jurisdiction of the City
of Bozeman providing for issuance of permits and collection of
fees therefor; and each and all of the regulations, provisions,
conditions and terms of such Uniform Code For Building
Conservation, copyrighted 1987, published by the International
Conference of Building Officials, all of which are on file in the

office of the Clerk of the City Commission are hereby referred
to, adopted and made a part hereof as if fully set out in this
ordinance.
Section 2.
Violations.
It shall be unlawful and punishable by fine not exceeding
Five Hundred Dollars ($500.00) for any person, firm, or
corporation to enlarge, alter, repair, improve or convert any
building or structure regulated by this code or permit the same
to be done in violation of this code. Each day said violation
continues shall be deemed a separate offense.
Section 3.
Savings Provision.
This Ordinance does not affect the rights and the duties
that matured, penalties that were incurred or proceedings that
were incurred or proceedings that were began before the effective
date of this ordinance.
Section 4.
Severability.
If any portion of this ordinance is declared
unconstitutional or the applicability thereof to any person or
circumstances is held invalid, the constitutionality of the
remainder of the ordinance and applicability thereof to other
persons and circumstances shall not be affected thereby.
Section 5.
This ordinance shall be in full force and effect on and
after June , ....2-' 1991.
PROVISIONALLY PASSED AND ADOPTED by the City Commission of
the City of Bozeman at a regular meeting thereof held on the 22nd
day of APril , 1991.
