ORDINANCE NO. 1312
AN ORD I NANCE OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, AMENDING A PORTION OF SECTION 1 OF
ORDINANCE NO. 1175, AS CODIFIED IN SECTION 2.36.030 OF
THE BOZEMAN MUNICIPAL CODE.
Preamble
The purpose of this ordinance is to change the name of the board
from "Recreation Advisory Board" to "Recreation and Parks
Advisory Board".
WHEREAS, the City Commission has considered and approved the
Recreation Advisory Board's request to change its name from "Recreation
Advisory Board" to "Recreation and Parks Advisory Board."
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONT ANA:
Section 1
That a portion of Section 1 of Ordinance No. 1175, as codified in Section
2.36.030 of the Bozeman Municipal Code be, and the same is hereby amended,
to read:
2.36.030 Recreation and parks advisory board creation, membership and
meetings.
A. The city commission shall appoint a recreation and parks advisory
board with th ree (3) year staggered terms, hereinafter referred to as the
"board," which shall consist of n+ne up to twelve (12) members, representing as
many facets of recreational programs as possible and selected as follows:
1. Five shall be se lected by the city commission and shall
reside within the city limits of the city of Bozeman;
2. Two shall be recommended by the School District No. 7
Board of Trustees, with final appointment to be made by the city
commission; and
3. Two shall be recommended by the board of commissioners
of Gallatin County, Montana, with final appointment to be made by
the city commission.
4. Up to three (3) additional "at large" members may be
appointed by the city commission, with city residency being a
consideration, but not a mandatory requirement. However, a
majority of the members on said board, regardless of its size,
shall be residents of the city of Bozeman.

(The intent is to keep Gallatin County and the School Dis-
trict input with the Board).
B. The board shall hold an annual meeting in January, at which
meeting it shall elect one of its members as chairman of the board to serve as
such for the ensuing year; and it shall hold such other meetings as may be re-
quired to transact business which may come before it. A majority of the voting
members of the board shall constitute a quorum for the purposes of conducting
business. Regular meetings will be held on such dates as may be set by the
board, and special meetings may be held on any date at the request of a ma-
jority of the members of the board, the city manager or the city commission.
All meetings shall be open to the public. Reasonable public notice shall be
given prior to all regular and special meetings.
Section 2
That a portion of Section 1 of Ordinance No. 1175, as codified in Section
2.36.040 be deleted.

Section ~3
That a portion of Section 1 of Ordinance No. 1175, as codified in Section
2.36.050 of the Bozeman Municipal Code be, and the same is hereby amended,
to read:
2.36.050 Board, ex-officio member.
The city manager, or a designee, shall be an ex-officio, nonvoting mem-
ber of the board. It shall be his duty to keep the board informed as to city
pol icies, the city budget, to make available to them any information which he
deems pertinent to the recreation and parks advisory board.
Sect ion 34
That a portion of Section 1 of Ordinance No. 1175, as codified in Section
2.36.060 of the Bozeman Municipal Code be, and the same is hereby amended,
to read:

2.36.060 Board secretary.
The board shall select a secretary, who shall attend all meetings of the
board and keep correct minutes of all proceedings of the board in a book to be
provided for that purpose, to be called the "record of the recreation and parks
advisory board of the city of Bozeman" and shall perform such other duties
necessarily implied by the activities and duties of the board. The sec reta ry
may be an employee of the city approved by the city manager or a board mem-
ber.
Section ~5
Savings Provision
This ordinance does not affect rights and duties that matured, penalties
that were incurred or proceedings that were begun before the effective date of
this ordinance.
Section S6
Severability
I f any provision of this ordinance is declared unconstitutional, or the
applicability thereof to any person or circumstance is held invalid, the con-
stitutionality of the remainder of the ordinance and the applicability thereof to
the other persons and circumstances shall not be affected thereby.
