HomeMy WebLinkAboutOrdinance 90- 1307 Rezone (22) - .. ~ ORDINANCE NO. 1307 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE ZONING DISTRICT DESIG- NATION FROM AN IIASII (AGRICUL TURAL SUBURBAN) TO AN IIRS-111 ( RESIDENTIAL--SUBURBAN COUNTRY ESTATES, ONE- ACRE MINIMUM) DISTRICT ON PROPERTY IDENTIFIED AS BEING APPROXIMATELY 80 ACRES LOCATED IN THE NORTHWEST ONE- QUARTER OF SECTION 20, TOWNSHIP 2 SOUTH, RANGE 6 EAST, MONTANA PRINCIPAL MERIDIAN, GALLATIN COUNTY, MONTANA, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA: WHEREAS, the proposed zone map change has been properly submitted, reviewed and advertised in accordance with the procedures of Title 18 of the Bozeman Municipal Code; and WHEREAS, the City-County Planning Board held a public hearing on Feb- ruary 26, 1990, to receive and review all written and oral testimony on the request for a zone map change; and WHEREAS, the City Commission held a publ ic hearing on March 19, 1990, to receive and review all written and oral testimony on the request for a zone map change; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established In Section 76-2-304, M,C.A. , and found the proposed zone map change to be in compliance with the twelve criteria; and WHEREAS, the City Commission has found that the proposed zone map change would bring the zoning of the property into compl iance with the Bozeman Area Master Plan and would be in the public interest. NOW THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: That the zoning district designation of the following-described property shall be and is hereby changed from an IIA-SII (Agricultural Suburban) District to an II RS-111 (Residential--Suburban Country Estates, One-Acre Minimum) Dis- trict: A tract of land being a portion of the northwest one-quarter of Section 20, Township 2 South, Range 6 East, Montana Principal Meridian, Gallatin County, Montana and being further described as follows: Beginning at the northeast corner of said northwest one-quarter, said point also being the north one-quarter corner of said sec- tion. Thence south 00028'3111 west along the east line of said northwest one-quarter, a distance of 2651,80 feet. Thence north 89029'2611 west along the south line of the southeast one-quarter of said northwest one-quarter, a distance of 1328.57 feet. Thence north 8902811411 west along the south line of the southwest io 1 . ,. one-quarter of said northwest one-quarter, a distance of 138,00 feet. Thence northerly along the approximate ridge line through the following courses: north 1002315911 west a distance of 624,67 feet; north 2002913911 east a distance of 756.91 feet; north 13023101" east a distance of 894.29 feet; north 17036'2311 east a distance of 477,11 feet.
