Amendment#4 Scope of Services
• TASK 1 - OUT OF SCOPE DESIGN PHASE ITEMS (LUMP SUM)
• TASK 2 - BID TO AWARD PHASE (TIME & MATERIALS)
• TASK 3 - CONSTRUCTION PHASE (TIME & MATERIALS)
• TASK 4 - POST-CONSTRUCTION PHASE (TIME & MATERIALS)
This contract amendment includes additional services to complete the section of the Baxter Lane
Improvements Project from North 191h Avenue to North 7th Avenue. The scope of work for Amendment#4
includes services for out of scope design phase items, advertising and bidding, construction
administration and observation,and post-construction services.
TASK 1 - OUT OF SCOPE DESIGN PHASE ITEMS
Management
This activity includes preparation of the scope of services, cost estimate, and contracting documents.
Also included in this activity are general management tasks including budgets and invoicing.
19th Ave. ADA Design
This work is the additional sidewalk, curb, and ADA ramp design in the NE quadrant of the Baxter Lane
and North 19th Avenue intersection, per MDT's review comments. The existing ramps were recently
installed with the Town Pump site work, but are not ADA compliant and were documented as substandard
in the MDT database. This work also includes revising plan sheets for the staking detail, roadway plan &
profile sheet, electrical, pavement markings, and subsequent quantities.
Parcel 14 Driveway
This work is adding a driveway for Parcel 14 (Town Pump) in order to obtain the right-of-way acquisition.
This work includes revising the staking detail, roadway plan & profile sheet, and subsequent quantities.
This work also includes providing electronic files and an exhibit sheet to DOWL during the right of way
acquisition process.
Additional Staking Details
This work is adding staking details for the design of individual ADA ramps per MDT's comments, instead
of providing a generic ADA ramp detail. The work covers detail sheets for the additional 14 ADA ramps
along Baxter Lane from NA5th Avenue to N. 71h Avenue. The staking details include curb slopes, sidewalk
slopes, ramp slopes and dimensions, staking points, and coordinate tables.
Hydraulics Report 100 Year Calculations
This work is the analysis, calculations, and documentation of the 100-year storm event as part of the
Hydraulics Report, per MDT's review comment. The hydraulics report and appendix were revised to
include the analysis requested by MDT,which is not typically part of the City of Bozeman report.

from 19th Avenue to 7th Avenue Scope of Services, September 2017
Miscellaneous Hydraulics Design
This work are the plan revisions for the revised City of Bozeman's Modifications to MPWSS for inlet
grates and 18-inch sumps on storm drain inlets.
Edge Drains
This work is the design and plan revisions for an edge drain system, requested per MDT Geotechnical
due to the high groundwater. The plan revisions include adding edge drain details, outfalls, pipe invert
elevations, cross section revisions for the system, and subsequent edge drain quantity calculations. A
special provision was also added to the contract documents for the edge drain system.
Transfer Signal
This work is transferring the signal design files and plan sheets from the Davis to 191h project to this 19"'
to 71i project, since the Baxter/Davis project was on hold due to right-of way acquisition. The design files
and models require clipping and merging and level adjustments between the two project design files. This
work also includes merging and/or separating the special provisions, quantities, engineer estimate items,
and revising the sheet numbering.
Cold Mill Connection
This work is adding a pavement notch cold mill detail per MDT review comments. Four cold mill
connections were added to the plans. The pavements marking plans and staking callouts were revised to
include the additional area. Quantities were added for cold milling, and revised for striping and surfacing.
Environmental Checklist and Encroachment Permit
This work is the investigation, coordination, documentation, and preparation of the Environmental
Checklist and Encroachment Permit per MDT review comments. The Environmental Checklist included
searches of and/or coordination with cultural resources, historic agencies, ecological services, farmland
designations, and environmental permitting agencies.
Wetland Permitting Coordination
This work is the additional site visit and extra coordination requested by the Army Corps of Engineers
regarding the wetland delineations on the project site, in order to secure the 404 Individual Permit.
Parcel 15 Sidewalk Revisions
This work is the removal of the sidewalk for Parcel 15 from the plan set, due to lack of right-of-way
acquisition. The detail sheet, staking layout, cross sections, grading, and project quantities were revised.
QA/QC Review
This work is the additional QA/QC review necessary after the significant design and drafting of the out of
scope items noted previously, as requested by MDT during their review process.
TASK 2 - BID TO AWARD PHASE
Task Description: This task order is for completing the bid to award phase. This includes preparing the
Contract Documents for bidding, advertising the project, bidding the project, awarding the project to the
lowest responsible bidder, and completing the executed contract documents.
Print&Assemble Contract Documents
The Consultant will print and produce twenty (20) paper sets and a .PDF set of the Drawings and
Contract Documents. The .PDF set will be posted on RPA's website for viewing by potential bidders.
Robert Peccia and Associates Page 2 of 6 Exhibit C
Baxter Lane Improvements,
from 19th Avenue to 7tn Avenue Scope of Services, September 2017
The City will receive two paper sets of the Contract Documents. The Consultant will receive four paper
sets of the Contract Documents. Four paper sets will be retained to give to the successful low bidder.
The remaining paper sets will be available for potential bidders to purchase, if they do not wish to print
their own sets from RPA's website.
Advertise for Bids
The Consultant will coordinate the advertisement for bids in the Bozeman Chronicle. The dates of
advertisement will be determined by the City of Bozeman.
Pre-Bid Conference
The Consultant shall schedule and conduct a Pre-Bid Conference for the project. The location and time
for the Pre-Bid Conference will be clearly stated in the Invitation for Bids. The intent of this conference is
to make the Contractors fully aware of the project requirements.
The Consultant is responsible for conducting the meeting and taking meeting notes and answering any
technical questions. The Consultant will send the City a copy of the Pre-Bid Conference Sign-In Sheet,
the Pre-Bid Conference Agenda, and the conference meeting notes.
Planholder's List
The Consultant will distribute the Contract Documents to those Contractors who request them and ensure
the Contractors supplied the proper deposit. The Consultant will maintain a Planholder's List which
identifies all Contractors which have received the Contract Documents.
Issuing Addenda
If necessary, addenda will be issued to make clarifications or changes in the Contract Documents prior to
the bid opening. All written addenda issued will become part of the Contract Documents and a copy of
the addenda shall be sent to everyone on the Planholder's List.
Bid Opening
The City Clerk will run the Bid Opening, and the Consultant will attend. The Consultant will review all bids
received for bid irregularities. Items to be reviewed include the Bid Bond, math errors in the bid,
acknowledgment of receipt of addenda, Contractor's registration number and proper completion of all bid
document forms. If irregularities are discovered in the low bidder's package, the Consultant shall bring it
to the attention of the City.
Bid Tabulations
The Consultant shall return from the Bid Opening with all the Contractor's Official Bid Proposals so the
Consultant can prepare the bid tabulations. The Consultant is responsible for transferring the unit bid
prices and total bid prices shown in the Contractor's bid onto a Bid Tabulation Sheet. Any math errors in
the Contractor's bid will be noted on the bid tabulations and the correct figure shown.
Award Recommendation
After the Bid Tabulations have been prepared and approved, the Consultant shall write a
Recommendation of Award e-mail to the Client. A copy of the Bid Tabulations shall be attached to this e-
mail. The Recommendation of Award shall be based on the lowest responsive bid, the absence of any bid
irregularities (or in accordance with an Attorney's opinion in the case of bid irregularities), and the ability
of the Contractor to perform the work. If the Contractor's qualifications are not known, a Pre-Award
Conference may be required prior to the Recommendation of Award.
The intent of a Pre-Award Conference is to determine if the Contractor is qualified to properly complete
the work within the allotted construction time. If after the Pre-Award Conference it appears the Contractor
Robert Peccia and Associates Page 3 of 6 Exhibit C
Baxter Lane Improvements,
from 19th Avenue to 7th Avenue Scope of Services, September 2017
is qualified to complete the project, the Consultant shall recommend award to the Contractor. If the
Contractor does not appear to be qualified, the Consultant shall recommend to the City the Contractor's
bid be disqualified and the next lowest bidder be considered, or that all bids be rejected and the project
be re-bid, whichever the City Attorney believes to be appropriate. The Consultant does not have the
authority to make these decisions for the City.
Notice of Award and Executed Contract Documents
Once a Contractor has been approved by the City, the Consultant shall complete and transmit five copies
of a Notice of Award to the City for their signature. The City shall be asked to sign the Notices and return
to the Consultant for them to transmit all of them to the Contractor for their signature. After the Contractor
signs the Notice of Award, the Consultant shall transmit five copies of the Agreement Between City and
Contractor to the Contractor. The Contractor will sign and return all copies, along with the required
Performance and Payment Bonds, Certificates of Insurance, and Power of Attorney. This set of
documents is the Contract Documents.
Upon receipt of the Contract Documents from the Contractor, the Consultant shall review the Agreement,
Performance Bond, Payment Bond, Certificates of Insurance, Power of Attorney, and Workers'
Compensation Certificate for conformance with the project requirements. The Consultant will bind the
Contract Documents, along with copies of the Bid Proposal, Bid Bond and Bid Tabulations, and send the
five sets to the City for review and signatures. Once executed, this bound book will be the Executed
Contract Documents.
TASK 3 - CONSTRUCTION PHASE
Task Description: This task order is for providing construction management and administration during
the construction of the project.
Preconstruction Conference
The Consultant shall schedule a Preconstruction Conference (Pre-Con) with the City, Contractor,
subcontractors, and any other applicable representatives and governmental agencies. The Consultant
will provide the Contractor with two sets of the Executed Contract Documents. The Consultant is
responsible for conducting the Pre-Con and preparing meeting minutes.
Submittal Review Process
The Consultant is responsible for ensuring the submittals received from the Contractor are reviewed and
returned within the allowed time frame. A Submittal Log shall be maintained and kept current during the
Submittal Review process. This Submittal Log will provide a permanent record of when submittals were
received, when submittals were returned, and what actions are required of the Contractor.
Each individual submittal received from the Contractor shall be reviewed and recorded on a Submittal
Review Form. This form will be returned to the Contractor with additional comments if necessary.
Construction Administration and Observation (150 Calendar Days)
The Consultant will assign a Resident Project Representative (RPR) to act as the construction observer
and project administrator for the project. Duties include field checks of materials and equipment,
documentation, overseeing required testing, reporting deficient work, verifying all testing, maintaining all
files and log books, and conducting inspections.
This Representative will be on-site eight (8) hours per day during construction activities and will observe
the Contractor's performance in comparison to plans and specifications. The RPR will be budgeted to be
on-site 40 hours/week and will have an additional five to ten hours/week of office time. Additionally, other
Robert Peccia and Associates Page 4 of 6 Exhibit C
Baxter Lane Improvements,
from 19th Avenue to 7th Avenue Scope of Services, September 2017
members of the Consultant's team will periodically be needed to assist during construction either in the
office or on-site.
The construction is not anticipated to exceed 150 calendar days (approximately 115 working days). The
RPR time is anticipated not to exceed 100 field days and 15 office days. Should the Contractor decide to
do work requiring observation on weekends or beyond the scheduled project completion date, the
Contractor could be assessed for reimbursed engineering fees to compensate for the additional time.
Additionally, if the scope of work changes significantly enough to warrant an extension of time for the
Contractor, the Consultant will be compensated for additional time and expenses as well.
No quality control testing of material is included in this agreement. Such independent testing laboratory
work will be through the Owner's Testing Firm, with the laboratory test results being submitted
simultaneously to the Contractor and Consultant for review.
Partial Pay Requests
Partial Pay Requests are processed periodically throughout the course of the construction project. Normal
projects allow the Contractor to request partial payments every 30-days. The Consultant is responsible
for certifying each pay request.
Change Orders
Any changes in the original Contract Documents shall be handled through the issuance of a Change
Order. In the event a Change Order is required; the Consultant shall process the Change Order. The
Consultant shall notify the City of the potential Change Order prior to negotiating the change with the
Contractor to obtain the City's approval of the need for the change. A detailed cost breakdown must be
provided by the Contractor so the Consultant may review it for reasonableness.
The Consultant is responsible for executing the Change Order and providing it to the Contractor for their
acceptance signature. The Consultant shall transmit a signed copy to the City for their review, approval
and signature. The Consultant shall transmit a signed copy of the Change Order to the Contractor which
will serve as their notice to proceed with the changes.
Project Punchlist & Certificate of Completion
After the Contractor has submitted the Contractor's Certificate of Completion, it shall be the Consultant's
responsibility to perform a thorough review of the project and prepare and issue the Contractor a Project
Punchlist. The Punchlist should detail the remaining work items and site cleanup the Contractor must
complete prior to the Final Project Inspection. The Punchlist should be signed by the Consultant and
copies should be given to the Contractor and the City. The Contractor's satisfactory completion of the
Punchlist items does not constitute final acceptance of the project, it merely means that the Contractor is
ready for Final Inspection with the City.
Final Project Inspection
Representatives of the City, the Contractor, and the Consultant shall visit the project site for a Final
Project Inspection. A walk-through inspection shall be conducted to provide the City the opportunity to
comment on the quality of the finished project, to point out work items or cleanup which require additional
work, or accept the project as complete.
If the City requires the Contractor to perform additional work, the Consultant shall document the work
items in a Final Project Punchlist. Copies of this Final Project Punchlist shall be transmitted to the
Contractor, the City, and the Consultant. If the City determines that the project is substantially complete,
then the Consultant shall prepare and obtain the necessary signatures on the Certificate of Substantial

Completion. The date of"substantial completions" triggers the end of contract time and the start of the
warranty period.
Management
This activity includes preparation of the scope of services, fee estimate, and contract amendment. Also
included in this activity are general management tasks including budget, invoicing, and progress reports.
TASK 4 - POST-CONSTRUCTION PHASE
Task Description: This task order is for providing construction management and administration after the
Contractor has completed the construction of the project and substantial completion has been granted.
Final Punchlist Review
The Consultant shall make a final inspection, when notified by the Contractor, that they have completed
all items on the Final Punchlist.
Contractor's Final Pay Request
The Contractor is responsible for submitting a Final Pay Request to the Consultant for processing. This
Final Pay Request shall be processed identically to the partial pay requests; with the exception that all
previous retainages withheld shall be released.
Prior to processing the Final Pay Request, the Consultant shall require the Contractor to submit an
Affidavit on Behalf of Contractor form and Consent of Surety Company to Final Payment form. These
forms are the Contractor's guarantee that all bills for materials, supplies&labor have been paid in full and
that no additional claims will be made against the City as a result of the Contractor's actions and that the
final payment shall not relieve the Surety Company of any of its obligations.
Record Drawings
The Consultant is responsible for producing the Record Drawings at the conclusion of the Project. The
Consultant and the Contractor shall maintain a set of record construction plans during the course of
construction, noting all design changes, underground utilities, and etc. All sets of drawings shall be
presented to the Consultant in a neat and understandable condition for final revisions. The Consultant
shall carefully review the changes made for accuracy and completeness. The record drawings will be
drafted and delivered to the City. The submittal will include electronic PDF's and AutoCAD files, two
paper copies, and one mylar copy of the record drawings.
Warranty Inspection
The Consultant will schedule and attend a Warranty Inspection. The primary objective of the inspection is
to test all the facilities and materials for proper functioning prior to the expiration of the Contractor's
warranty on parts and labor.
