COMMISSION RESOLUTION NO. 3883
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE GROWTH POLICY LAND USE DESIGNATION,
FROM FUTURE URBAN TO RESIDENTIAL ON 75.03 ACRES LOCATED IN THE
NORTHEAST QUARTER OF SECTION 16, TOWNSHIP 2 SOUTH, RANGE 5 EAST,
PRINCIPAL MERIDIAN MONTANA, GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed amendment to the Bozeman 2020 Community Plan, to amend the
growth policy land use designation, as shown on the Future Land Use Map, from Future Urban to
Residential on 75.03 acres, has been properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Planning Board held a public hearing on September 20. 2005. to
receive and review all written and oral testimony on the request for a growth policy amendment; and
WHEREAS, the Bozeman Planning Board voted 4 in favor and 1 against to recommend to the
Bozeman City Commission that the growth policy amendment be denied as proposed; and
WHEREAS, after proper notice, the City Commission held its public hearing on October 3, 2005.
to receive and review all written and oral testimony on the request for a growth policy amendment; and
WHEREAS, the City Commission has reviewed and considered the four growth policy
amendment criteria established in Section 2.4.1 of the Bozeman 2020 Community Plan, and found that
the growth policy amendment as proposed would not be in compliance with the four criteria; and
WHEREAS, at its public hearing held on October 3. 2005, the City Commission found that the
proposed growth policy amendment would be in compliance with Bozeman's adopted growth policy and
would be in the public interest if the entire property was designated Residential.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the growth policy land use designation of the following-described properties is hereby
designated as Residential:
A parcel of land, said parcel being Tract 1 of Certificate of Survey No. 24 and all of
Certificate of Survey No. 25, excepting therefrom the property described in the
Bargain and Sale Deed recorded in Book 120 on Page 327 of Gallatin County records,
said parcel being located in the Northeast Quarter of Section 16, Township 2 South,
Range 5 East, Principal Meridian Montana. Gallatin County, Montana and said parcel
being further described as follows:
Beginning at the southwest corner of Certificate of Survey No. 24; thence North
00018'47" West, along the west line of said survey, a distance of 662.56 feet to the
southwest corner of Certificate of Survey No. 25; thence North 00021 '29" West, along
the west line of said Certificate of Survey No. 25. a distance of 1940.58 feet; thence
North 89003'02" East, along the southerly line ofthe property described in Book 120
on Page 327 of Gallatin County records, a distance of 1294.97 feet; thence North
89038'47" East, along said southerly line, a distance of 38.78 feet; thence South
00020'55" East, along the east line of said Section 16, a distance of 2428.06 feet to
the southeast corner of said Certificate of Survey No. 24;
The following 6 courses being along the southerly line of the Farmers Canal as shown
on said Certificate of Survey No. 24:
North 86016'14" West, a distance of 86.79 feet;
North 66043'13" West, a distance of 126.67 feet;
North 68012'19" West, a distance of 165.58 feet;
South 86051 '46" West, a distance of 105.69 feet;
South 63049'58" West, a distance of 693.00 feet;
Thence South 89024'28" West, along the south line of said survey, a distance of
248.40 feet to the Point of Beginning.
The described parcel contains 75.044 acres, more or less.
Section 2
This growth policy amendment shall be in full force and effect upon passage.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 19th day of December 2005.
