08:06:24 AM (00:04:09) Thane requested that the minutes be changed on p. 2 from: “Thane argued that
simplifying the development code would assist in making it possible for detached condos to be considered single
family homes by changing the lot line adjustment process” to “Thane argued that the development code should
be simplified so that single family homes can be built as easily as condos.”
08:07:25 AM (00:05:10) Thane also requested that on p. 5, the minutes are changed from: “Thane shared the
information that there’s a statute that discusses municipal providing less expensive” to “Thane shared the
information that there is a statute that discusses allowing municipalities to provide land below market value, but
it will be used for affordable housing.”

E. 08:09:32 AM (00:08:16) Action Items:
1. 08:10:13 AM (00:07:58) Status update from CAHAB Affordable Housing Ordinance (AHO) Revision
Subcommittee
Guyer informed the board that the Affordable Housing Ordinance committee determined that it was premature
to make changes to the ordinance prior to the updated Unified Development Code being solidified. The
subcommittee discussed a density first structure, assuming that density equated to affordability, tailoring a
three piece Affordable Housing Ordinance that offered incentives to developers, builders and buyers.
Board member Kevin Thane discussed previous board member Lewendal’s view that fees need to be collected
from the broader community, such as a fee applied to a water bill that would go toward affordable housing.
They also discussed increasing from 3 to 6 mills in order to increase the funds for affordable housing. Guyer
pointed out that he was not sure that he supported the idea of the broader community funding affordable
housing, but rather creating incentives that truly spur the construction of affordable housing.

08:22:23 AM (00:20:08) CAHAB discussed the current Affordable Housing Ordinance and proposed changes
which would exempt Condos.
2. 08:36:37 AM (00:34:22) Report on MSU Architecture Class dealing with Cemetery Land
Thane reported that he and board member David Magistrelli met with the MSU class assisting with cemetery
land that could be a possibility for land to be used for affordable housing. Thane provided background on the
land which is being considered.
3. 08:44:49 AM (00:42:33) Discussion of Accessory Dwelling Units (ADU’s) with letter from HJ Schmidt and
licensed architect Tammy Minge of Frog Rock Design, LLP
Board member Thane explained how ADUs contribute to affordable housing either by offering a less expensive
housing option for those looking to rent, a lower cost solution to elder family members who need more
assistance as well as an additional source of income for a household.
08:49:16 AM (00:47:01) Thane described some of the barriers to being eligible for an ADU, suggesting that
removing some of those restrictions would be beneficial to affordable housing.
08:53:34 AM (00:51:19) Board member Brooke Anderson asked at what point the ADU would be considered a
duplex from a financing standpoint. Board member Stratton commented that his subdivision, Valley West has
attached and detached ADUs and that the attached were the only ones with restrictions and that the size of the
house determined the size of the ADU.
08:55:23 AM (00:53:08) Thane asked how Valley West was able to move around the size restrictions for ADUs
and Stratton explained that they did this through a PUD, essentially writing their own code for the subdivision.
08:58:19 AM (00:56:04) MOTION that the board resolve to support the use of Accessory Dwelling Units as a way
to increase the supply of affordable housing.

08:59:05 AM (00:56:50) Discussion: Guyer commented on the letter referencing ADUs and stated that the home
in discussion, not able to build an ADU, is in a historic district, which would prevent it from being able to utilize a
PUD to move forward with an ADU. Guyer stated that there would be a need to look at the code and how it
impact ADUs in the historic district.
Public Comment:
09:00:11 AM (00:57:56) An individual commented that the State of Los Angeles is doing an incentive program for
people to build ADUs to house homeless people. They receive money from the city to help offset the cost of the
building/permitting in exchange to sign a clause to house homeless people for 5-7 years. She suggested the
thought of incentivizing ADUs to encourage affordable housing.

4. 09:01:40 AM (00:59:25) Update on response from the City Attorney regarding CAHAB question about the
legality of using a development fee (a % of the permitted project value) to be used to fund Affordable
Housing
Legal has yet to determine whether this type of fee would be legal due to their current workload.
09:05:10 AM (01:02:55) CAHAB members revisited the fee based alternative to the mandatory Affordable
Housing Ordinance. They discussed how this differs from the current Cash-In-Lieu option in the Affordable
Housing Ordinance.
09:07:00 AM (01:05:14) Stratton shared that he did a detailed review of the Affordable Housing Ordinance using
one of his projects and he determined that the cash in lieu option (utilized in lieu of building an ‘affordable’ unit)
was not worthwhile as it could cost hundreds of thousands of dollars with how it is determined. He stated that
the value of that cash could be more than the house and suggested that that be a more feasible number, pre-
defined as opposed to an arbitrary calculated number.
09:09:11 AM (01:07:06) Guyer shared that in Utah, the affordable housing cash number was a predetermined
fee of $82,000, which was substantially easier than the current Cash In Lieu calculation for Bozeman’s Affordable
Housing Ordinance.
09:10:25 AM (01:08:10) Thane suggested that in a future CAHAB meeting, they revisit how the affordable
housing fund money is utilized and suggesting looking at other options outside of purchasing land. He used an
example provided by Director Matsen where the community provided infrastructure that was used to support
lots on which affordable housing could be built. Thane suggested looking at using some of the affordable
housing fund money for infrastructure to lower the cost of construction to incentivize housing.
