When looking at Section 3 of the UDC Update please take a careful look at footnote 11 of Section 30.310.040.B of
the proposed update that pertains to permitted residential & industrial uses in commercial, mixed-use, and
industrial zoning districts. This footnote change seems innocuous but has far reaching consequences.
The footnote in the current code, found in 38.12.020 of the current municipal code as footnote 7 reads ,”For the
purposes of this section, accessory means less than 50 percent of gross floor area of a building, and being generally
located on the second or subsequent floor.
The footnote in the corresponding section of the proposed UDC, found in 38.310.040.B as footnote 11 states, “For
the purpose of this section, accessory means less than 50 percent of the gross floor area of the building, and not
located on the ground floor.”
The proposed change limits accessory uses to the second or subsequent floor of a structure and does away with
the possibility of having accessory uses on the ground floor or in an accessory building that is on ground level. The
proposed change limits creativity in the design of a facility with accessory uses and places unnecessary restrictions
in the design of multiuse facilities.
For the sake of encouraging the best and highest functional use of Bozeman’s limited land resource please leave
the wording of the current code rather than replacing it with the more restrictive language that is proposed.
