A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, LEVYING AND ASSESSING A $2 PER ROOM NIGHT FEE FOR
OVERNIGHT STAYS AT LODGING FACILITIES LOCATED IN THE BOZEMAN
TOURISM BUSINESS IMPROVEMENT DISTRICT (TBID) FOR THE FISCAL YEAR
2018.
WHEREAS,the City Commission of the City of Bozeman created the Bozeman Tourism
Business Improvement District,pursuant to the provisions of Title 7, Chpt. 12, Part 11,MCA, for
the purpose of aiding tourism, promotion, and marketing within the district; and
WHEREAS, the City Commission codified the TBID at Chpt. 3.22 of the Bozeman
Municipal Code; and
WHEREAS, the City Commission of the City of Bozeman did, on the 12th day of June,
2017, following notice and public hearing, approved the Fiscal Year 2018 work plan and budget
for the Bozeman Tourism Business Improvement District; and
WHEREAS, the FY 2018 work plan and budget provides for every lodging facility
included within the boundaries of the Bozeman Tourism Business Improvement District that
provides ten (10) or more rooms for temporary overnight accommodations, lodging, dwelling, or
sleeping facilities for transient guests, and hostels, subject to the exemptions described in
3.22.020.17, BMC, to assess a $2.00 per occupied room night fee for overnight stays, pursuant to
Section 7-12-1133 (2)(c), MCA; and

WHEREAS, to defray the costs of the tourism business improvement district for the
coming assessment year (FY 2018) the Commission must now establish the assessment to be
levied for said year.
NOW, THEREFORE, BE IT RESOLVED THAT:
Section I
In accordance with 3.22.020.,Bozeman Municipal Code,and Title 7, Chapt.12,Part 11,MCA,the
Bozeman Tourism Business Improvement District assessments for lodging facilities which
provided ten (10) or more rooms for temporary overnight accommodations, lodging, dwelling, or
sleeping facilities for transient guests, and hostels, subject to the exemptions described in
3.22.020.F, BMC, during the time period of July 1, 2016 and June 30, 2017 shall be as described
in Exhibit A.
Section 2
This assessment is levied to fund the district's work program for Fiscal Year 2018 (July 1, 2016
through June 30, 2017), will be billed in October 2017, and collected as are all other special
assessments.
Section 3
It is the intent of the Commission that for the fiscal year beginning July 1, 2017, every lodging
facility included within the boundaries of the Bozeman Tourism Business Improvement District
that provides ten(10)or more rooms for temporary overnight accommodations,lodging, dwelling,
or sleeping facilities for transient guests, and hostels, subject to the exemptions described in
3.22.020.F,BMC, shall be required to collect a$2.00 per room night fee for overnight stays. This
collection will form the basis for the assessments to be calculated in approximately September
2017 and be specifically calculated and assessed by subsequent Resolution of the Commission to

each property in October 2017. The assessment to be levied in October 2017 will be used to fund
the work program for Fiscal Year 2018 (July 1, 2017 through June 30, 2018).
Section 4
Disposition of Collections - That the assessments as collected shall be placed in the business
improvement district fund and shall be used to defray the costs thereof as provided by law.
PASSED, ADOPTED, AND APPROVED by the City Commission of the City of
Bozeman,Montana at a regular session thereof held on the 18th of September, 2017.
