MEMORANDUM OF AGREEMENT
AGREEMENT has been reached this day of , 2012, between BAXTER
MEADOWS MASTER COMMUNITY ASS C`IATION, INC., the organization that maintains the public park
further described as the Public Park in Block 17 of Baxter Meadows Subdivision Phase 3A, located in
Section 34, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County, Montana,
according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of
Gallatin County, Montana, and the CITY OF BOZEMAN for the replacement of one (1) tree removed for
the said road project. The amount to be paid and other considerations to be given in full satisfaction of
this Agreement are as follows:
Tree Replacement: $ 1,200
Total (rounded) $ 1.200

Other Conditions:
1. This Memorandum embodies the whole Agreement between the parties hereto as it pertains to
the replacement of one (1) tree, and there are no promises, terms, conditions or obligations
referring to the subject matter hereof, other than as contained herein.
2. This Agreement shall be deemed a Contract extending to and binding upon the parties hereto and
upon the respective heirs, devisees, executors, administrators, legal representative, successors
and assigns of the parties, only when the same shall have been approved by the City Manager on
behalf of the Public Works Department.
3. The northwest tree will be removed. The southern tree was removed prior to the project. The
northeast tree will remain. The existing sign and landscaping will remain. The existing
underground irrigation system impacted by the project will be repaired with this project. (See
Figure 1 attached
Of the total amount of compensation hereinabove agreed upon, the sum of $1,200 shall be paid upon
execution and delivery of a good and sufficient: ® Memorandum of Agreement and the balance of the
compensation, amounting to $ 0.00 shall be paid upon compliance by the owner(s)with the terms hereof.
Disbursement of funds will be made in the following manner:
Amount of Payment
Baxter Meadows Master Community Association, Inc. $1,200
The terms of this Agreement are understood and assented to by us and payment is to be made in
accordance with the above.
