Task Order No.3 -Professional Services Agreement with DOWL,LLC
for the
Bozeman Sports Park Trails, Open Space,and Parks Bond Project
THIS AGREEMENT is made as of this day of �M�£'Q. , 2017,between
THE CITY OF BOZEMAN, a Municipal Corporation,P.O. Box 1230 Bozeman,
Montana,59771-1230 (CITY) and DOWL,LLC,whose address is 2090 Stadium Drive,
Bozeman,Montana 59715, (CONSULTANT).
WHEREAS,the parties have entered into a Professional Services Agreement dated May 18,
2015, for design and engineering of the Bozeman Sports Park; and
WHEREAS,revisions to the scope of services are necessary to complete the Project in
accordance with the Master Plan approved by Commission; and
WHEREAS, the parties desire to amend the provisions of this Agreement.
NOW,THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
CONTAINED HEREIN, the parties agree as follows:
The conditions and provisions set forth in the attached Task Order No. 3 for the Scope of
Services for the Bozeman Sports Park("Exhibit A") are hereby incorporated in and made
part of this agreement.
Section 4—Payment:
Section 4 of the original agreement is modified to include:
Task Order No. I.........$253,480
Task Order No. 2.........$179,460
Task Order No. 3.........$100,000
Contract total..............$532,940
Except as specifically amended herein, the original agreement shall remain in full force and
effect and the Parties shall be bound by all terms and conditions therein.

Dear Carolyn:
DOWL is pleased to submit this proposal in response to the City for Inspections and Materials
Testing Services for the Bozeman Sports Park Phase 1A project. For our proposal, we have
based our inspection time and fee on and development of the site plans and specifications.
SCOPE
In developing our scope of work and cost DOWL has reviewed the Contract Documents,
including plans and specifications for the athletic fields, irrigation, utilities, and site-civil work.
DOWL will be teaming with Steiner-Thuessen, and Siegfried to provide inspection services for
the Phase 1a improvements with a successful outcome. DOWL will perform inspection for
certain elements of the project as outlined below:
• Project Management
• Shop Drawing and Submittal Review
• Process RFIs
• Review Pay Requests
• Change order pricing review
• Construction Staking (limited)
• Materials Testing —Soils, Concrete and Asphalt
• Utility Testing
• Irrigation Inspection and Testing

• Control System Programming
• Soil Amendment Testing
These items are discussed in detail below.
Project Management
We have included a project management cost item which includes Project Management time
associated with attending weekly project meetings (estimated at 16 meetings), Quality
Assurance and other assumed project support coordination efforts.
Shop Drawing and Submittal Review
The design team will review all shop drawings and product submittals required by the
specifications to determine compliance with the drawings and specification. Contractor will
receive written response from reviewer.
Process RFIs
The design team will review and respond to any questions that come up from the contractor
during construction.
Change Order Pricing Review
The design team will assist the owner to see if proposed change order amounts provided by
subcontractors are reasonable and acceptable.
Construction Staking
DOWL will provide construction staking for project elements that are not required by the
contractor to stake (building pads, fencing, utilities, etc). Offset stakes will be set as requested
by the subcontractors. Any re-staking will be responsibility of the Contractor.
Materials Testing
Includes building pad preparation, backfill and compaction in play fields, parking areas and
sidewalks. Compaction testing will be performed with a nuclear density gauge to verify
materials below shallow foundations are adequate to achieve the design bearing capacity.
Evaluation of soils will be conducted with the combination of moisture-density relationships,
sieve analysis, and plasticity determination in the form of Atterberg limits. Concrete flatwork and
asphalt will also be tested.

Utility Testing
Water main extension will have full-time inspection. Leak testing and line disinfection will be
documented for the main to be put into service.
Irrigation Inspection and Testing
The design team will make site visits during construction of the irrigation system to ensure
compliance with the drawings and provide guidance as necessary for field adjustments. It is
estimated that 9 site visits will be required for the irrigation system, pump station, plantings ,and
seeding components of the project.
Control System Programming
Steiner-Thuessen will provide basic programming of the central irrigation control system.
Changes during construction that necessitate adjustment to the programming will be the
responsibility of the contractor. The contractor will be responsible for final station assignments
and run times.
Soil Amendment Testing
Samples will be taken of the amended soil for testing to ensure amendments have been added
at the specified rates.
COST
DOWL proposes to work on a time and material basis not to exceed $100,000.00
