Impact Fee Payment Agreement with Cannery District for Oak Street Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Shawn Kohtz, Project Engineer Richard Hixson, City Engineer SUBJECT: Cannery District Phase 2 Impact Fee Payment Agreement Improvements to Oak Street MEETING DATE: September 18, 2017 AGENDA ITEM TYPE: Consent Agenda RECOMMENDATION: Authorize City Manager to sign BACKGROUND: Attached is a copy (original to City Clerk) of the City of Bozeman Impact Fee Payment Agreement for improvements to Oak Street. Engineering and Legal staff developed the proposed agreement in conjunction with the Developer, Cannery District Partners, LLC, who executed the agreement and returned it to the City for signature by the City Manager. Funds for improvements to Oak Street are in the approved capital improvements program as street impact fee and arterial and collector district project number SIF109 in Fiscal Year 2019. Per the attached agreement, the Developer will construct and pay for the Developer’s portion of the improvements, and the remainder of the improvements to Oak Street will be paid from the street impact fee and arterial collector district funds in SIF109. The Developer will not be reimbursed until the project is complete and not until the beginning of Fiscal Year 2019. FISCAL EFFECTS: Defined in the approved Street Impact Fee item SIF109 in the Capital Improvements Program and in the attached agreement.
