Pertzborn - UDC Update, Chapter 31 11 September 2017 Bozeman City Commission + Tom Rogers, Senior Planner, AICP City of Bozeman Department of Community Development RE: UDC Update SUBJECT: Chapter 3 (pg. 235) Detached Structure Setbacks Greetings - As part of the current UDC update and review, I ask that Staff and the City Commission consider revising/adding the following sentences relating to detached structures setback requirements (38.360.030.I.3). The current subsection reads (emphasis added): 3. Accessory structures greater than 600 square feet may not be located in any required front, rear or side setback and must provide adequate back up maneuverability for required parking spaces. The proposed edited subsection would read (emphasis added): 3. Accessory structures greater than 600 square feet may not be located in any required front, rear or side setback when no alley is present and must provide adequate back up maneuverability for required parking spaces. 4. Accessory structures greater than 600 square feet may be located in required rear setback when alley is present and must provide adequate back up maneuverability for required parking spaces. Historic and new alley patterns include a variety of structures and setbacks. The placement of structures larger than 600 SF should be different when an alley is present. One could even argue that structures larger than 600 SF should be required to be closer to an alley, but I don’t want to confuse the argument. 2 - I believe this option will allow better backyards, improved adjacencies to neighboring property, as well as encourage detached well designed garages (all while maintaining required distances for backing up, parking, massing, etc). - 20’ R.O.W. alleys with 20’ setbacks on each side (60’ effective visual width) can result in faster moving traffic and less safe conditions. - Several neighborhood design documents (Valley West, Cattail Creek, etc) actually regulate creating edges along alleys to make them safer. - 600 SF Garages should not be considered large. - Other parts of the code speak to sizes of detached structures (garages, etc). Note: Garages with double doors and that accommodate storage (and in some cases internal stairs) increase the chance that the space actually gets used for parking.
