We recommend changes to these two sections of the July 28, 2017 draft of the UDC Update:
Subsection 38.360.040.C.1. ADUs / Standards for all ADUs / Occupancy.
We strongly endorse the following InterNeighborhood Council ADU recommendation:
"Occupancy: The primary structure of the ADU should be occupied as a principal residence by one owner of record in ALL residential zoning districts not
just the current R-1 and R-S.
This is not just a historic district issue -- it is a citywide issue. We recommend that the INC recommendation be followed by moving subsection 38.360.040.C.1 Occupancy from
subsection 38.360.040.C Supplemental ADU provisions for the R-S and R-1 districts to subsection 38.360.040.A.4 Standards for all ADUs.
Subsection 38.360.040.D.1. ADUs / Supplemental ADU provisions for the R-2, R-
3, R-4, R-5, R-O, or REMU districts / Location
This section presently reads:
1. Location. The accessory dwelling unit may be:
a. Located in a detached structure on a lot with alley access; or
b. Located above a detached garage.
Item a, which is new, permits many hundreds of new dwelling units in Bozeman's historic
districts whose access is from alleys. If this section is adopted, within 10 years each of
up to 100 residential blocks will have 10 - 20 additional alley ADU residents, including
student renters and short-term renters ill-attuned to the attendant risks. In the historic
districts and other older neighborhoods, the widths of alley rights of way range from 12 ft
to 20 ft. Hundreds of existing accessory structures, some historic and some very new,
are built right up to the lot line adjacent to the alley, with zero setbacks. Such structures
create dangerous intersections of alleys with streets, sidewalks and bicycle routes, as
well as obvious dangers of greatly enhanced traffic to families with children.
We recommend that these obvious safety hazards by minimized by replacing the present
Sec. 38.360.040.D.1 with:
1. Location. The accessory dwelling unit may be located on an alley only if the
right of way width of the alley is 30 ft or more, and the ADU is:
a. Located in a detached structure; or b. Located above a detached garage.
