This Memorandum of Agreement (this 'Agreement') made this lay of
2017, between the CITY OF BOZEMAN, a municipal corporation of the State of Montana
(COB) and MONTANA STATE UNIVERSITY (MSU), describes the duties, agreements and
obligations of the COB and MSU in connection with drought communications research to
determine effective methods of communication regarding drought,water conservation, and
water use so as to inform methods to most effectively implement the City of Bozeman
Drought Management Plan communications campaign.
Article 1 - Roles and Responsibilities
A) COB and MSU agree to collaboratively develop project goals and interview/survey
questionnaire to meet the needs of both parties including those related to course
objectives and deliverables.
B) COB agrees to set up cohorts based upon a stratified random sample of high, medium
and/or low residential water users for the purpose of selecting interview candidates
for the study.
C) COB agrees to keep all personal information of water users included in the cohorts
anonymous. Water users randomly selected for the study will be assigned a
participant ID number to be used in all interactions with MSU to ensure anonymity is
maintained at all times.
D) COB agrees to contact a random sample of water users from cohorts via mail
explaining the project and providing water users with an option to participate in the
study with MSU. In the letter,water users will be asked to contact MSU directly if
they choose to participate.
E) MSU agrees to use the interview/survey questionnaire that is collaboratively
developed with COB in the participant interviews.Any proposed changes to the
questionnaire shall be approved by COB prior to interviewing participants.
F) MSU agrees not to represent COB in any manner throughout the course of the study.
G) MSU agrees to keep personal/identifying information provided by participants, if
any, such as name and other demographic data, anonymous.
H) MSU agrees to provide COB with results of study via deliverables to be agreed upon
by both parties.
I) MSU agrees to use professional communication and correspondence with COB and
study participants at all times.
J) MSU agrees to adhere to COB rules and procedures, including confidentiality of
organization and partner information,where applicable.
Article 2 -Duration of the Agreement
A) Should conditions arise which, in the sole opinion and discretion of COB, make it
advisable to COB to cease performance under this Agreement, COB may terminate
this Agreement by written notice to MSU ("Notice of Termination for City's
Convenience"). The termination shall be effective in the manner specified in the
Notice of Termination for City's Convenience and shall be without prejudice to any
claims that the COB may otherwise have against MSU.
Article 3 - Independent Contractor
A) The parties agree that MSU is an independent contractor for purposes of this
Agreement and is not to be considered an employee of the COB for any purpose.
Neither MSU nor any of its employees, officials, or agents, are subject to the terms
and provisions of the COB's personnel policies handbook and may not be considered
a COB employee for workers' compensation or any other purpose. MSU is not
authorized to represent the COB or otherwise bind the COB in any dealings between
MSU and any third parties.
Article 4-Non-Discrimination
A) MSU will not refuse employment to a person, bar a person from employment, or
discriminate against a person in compensation or in a term, condition, or privilege of
employment because of race, color, religion, creed, political ideas, sex, age, marital
status, national origin, actual or perceived sexual orientation, gender identity,
physical or mental disability.
Article 5 - Execution
IN WITNESS WHEREOF, the parties have caused this Agreement to be executed by their
authorized representatives, on the day and year first written above.
