Historic Preservation Advisory Board
and Design Review Board Joint Meeting
November 16, 2016

A. Call meeting to order and Roll Call
Bill Rea called the meeting to order at approximately 6:10 and called for attendance.

Chair Rea called for public comment. No members of the public offered comment.
E. Approval of Minutes – no action was taken.
G. Action Items
1. General overview of each board’s duties – presented by staff liaisons (est. 5-10
minutes each) with follow up discussion with boards (15 minutes)
Chris Saunders and Brian Krueger presented a description of the duties of each board. Discussion of
points of interaction between the two boards and the role they have in advising the City Commission and
Director of Community Development in making decisions on policy development and review of
applications. Cyndy Andrus explained how the Commission applies recommendations from the Boards.
2. Presentation by City Attorney on open meeting laws and similar procedural
issues for both boards (45-60 minutes)
Karen Stambaugh and Greg Sullivan distributed reference material on open meeting laws and procedures.
Discussion of how and why Bozeman has open meetings, nature of quasi-judicial reviews compared to
legislative procedures, avoidance of quorums outside of noticed meetings, restrictions on electronic
meetings, and ex parte communication was had. Note was made of the need to update the bylaws of the
DRB to meet the new Commission directed format.
3. Discussion of upcoming HPAB retreat in January (15 minutes)
HPAB members agreed additional discussion will occur at the December 13th meeting of the board.
H. FYI/Discussion
1. Staff Liaison report
Chris Saunders distributed public comment requesting the HPAB to become engaged in the City
discussions on accessory dwelling units. Mr. Saunders indicated that Tom Rogers could attend the next
meeting to describe alternatives and the upcoming code development process. The City Commission will
have a discussion on the same topic on December 5th regarding infill, housing diversity, ADUs, and other
topics. All are welcome to attend and participate. HPAB agreed they would like to have Mr. Rogers come
on December 13th.
