SUBJECT: Contract Award to Williams Brothers Construction for the WRF Small Works Project No. 1.

Small Works Project No. 1 to Williams Brothers Construction for Bid Items No. 1, 3, 4, 5, 6 (Bid
Item No. 2 is excluded) in the amount of $838,800. RECOMMENDED MOTION: I hereby move to direct the City Manager to sign the Notice of Award for the WRF Small Works Project No. 1 to Williams Brothers Construction for Bid Items
No. 1, 3, 4, 5, and 6, in the amount of eight hundred thirty eight thousand, eight hundred dollars,
and exclude Bid Item No. 2 from the award. BACKGROUND: WRF Small Works Project No. 1 consists of the following 6 individual capital improvement items packaged together into a single construction contract.

Bids were opened on August 1, 2017. One bid was received, and with a total price of $1,214,000, significantly exceeded the $866,718 engineer’s estimate. It appears that the construction market in Bozeman is operating at maximum capacity and that the bid prices reflect

an imbalance in supply and demand. We do not hold out hope that a more favorable price would
be received if the project is re-advertised for bid as there are no signals that the overall demand for work in the Bozeman area will be shrinking anytime soon. Should the City Commission adopt Resolution 4840 (budget amendment to the wastewater fund
for the WRF Small Works Project), $850,000 of funding will be available for construction. This
funding amount will allow five of the six bid items to be awarded (Bid Items No. 1, 3, 4, 5, and 6 in the amount of $838,000). Bid Item No. 2, secondary clarifier improvements, is excluded from the award. Although improvements to the secondary clarifiers are presently needed, they are not a priority item relative to the five other bid items in the recommended award. The secondary
clarifier improvements can be bid out again at a later date and packaged together with
rehabilitation work needed on the existing primary clarifiers to create a larger project. The highest priority item in the award is the rehabilitation of primary anaerobic digesters no. 1 and no. 2 and replacement of the membrane roof system over these digesters and digester control
building no. 1. The existing digester mixers require replacement as they are old and not able to
provide effective mixing of digester contents. Poor mixing inhibits the proper operation of the anaerobic digestion process. The existing mixer gas seals at digester 1 have failed and are causing intrusion of a large volume of digester gas into the membrane roof system. Digester gas is explosive if exposed to an ignition source so the gas entrapped under the membrane roof
material is a hazardous situation in need of an immediate fix. Furthermore, the membrane roof
has failed in multiple locations and leaks water into the digester control building and old administration and lab rooms. Full replacement of the roof is necessary to bring these assets into proper repair and set upon a proactive asset management track.
Remaining items in the award include replacement of old waste activated sludge pumps and
installation of new variable frequency motor drives for the new pumps, as well as minor piping modifications at various locations about the WRF. The $850k total funding affords a modest construction contingency of $11,200 which could be
used if conditions encountered during prosecution of the work differ from those precedent in
preparation of the bid and a Change Order is approved. The Notice of Award for the referenced project is attached along with the bid tabulation.
FISCAL EFFECTS: Contract award as recommended would reduce the amended FY17
wastewater fund balance by $838,800. Award at this amount requires Commission approval of Resolution 4840 to make a total of $850,000 available for the project. ALTERNATIVES: As suggested by the Commission

1. Deliver to the Owner 4 fully executed counterparts of the Contract Documents.
2. Deliver with the executed Contract Documents the Contract security Bonds as specified in Section 00100, Instructions to Bidders (Article 20), and General Conditions (Paragraph 2.01 and 5.01) and Supplementary Conditions (Paragraph SC-2.01).
Failure to comply with these conditions within the time specified will entitle Owner to consider you in default, annul this Notice of Award and declare your Bid security forfeited.
Within fifteen days after you comply with the above conditions, Owner will return to you two fully executed
counterparts of the Contract Documents.
