Task Order 3 with DOWL for Bozeman Sports Park Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Carolyn Poissant – Manager of Trails, Open Space, and Parks Design and Development Mitch Overton – Director of Parks and Recreation SUBJECT: Task Order No. 3 - Professional Services Agreement with DOWL, LLC for Bozeman Sports Park Project MEETING DATE: August 28, 2017 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign Task Order No. 3 of the Professional Services Agreement (Attachment A) with DOWL, LLC, hereinafter referred to as, “Consultant” for construction administration and testing for the Bozeman Sports Park Trails, Open Space and Parks Bond Project for an amount not to exceed $100,000 (contract total of $532,940). BACKGROUND: Resolution No. 4521 was unanimously approved by the Commission April 14, 2014 for the allocation of Trails, Open Space and Parks (TOP) bond funding in an amount not to exceed $7,500,000 for the acquisition of park land and development of the Bozeman Sports Park Project (“Park Project”), which requires the assistance of a professional design and engineering team. The resolution allocated up to (i) $2,100,000 for the acquisition of approximately 80 acres of park land; (ii) up to $1,788,000 for infrastructure improvements as stated in the Commission motion adopted April 7, 2014; and (iii) the remainder of the $7,500,000 for park development and construction of the approved park master plan. A consultant team led by DOWL, LLC was selected and awarded the design services contract for the Sports Park. The consultant’s Scope of Work for Task Order No. 1 ($253,480) was completed with Commission approval of the Sports Park Master Plan on July 11, 2016. Task Order No. 2 ($179,460) included preparation of the Phase I site plan and construction documents and close coordination with the General Contractor Construction Manager. Task Order No. 3 includes value engineering, bidding assistance, construction administration, and testing, on a time and materials basis for an amount not to exceed $100,000, bringing the total contract amount to $532,940. Task Order No. 3 Scope of Services is attached (Attachment A – Exhibit A). The total contract to date for Task Order Nos. 1, 2, and 3 is $532,940 (13% of the construction project budget). . 57 UNRESOLVED ISSUES: City engineering, community development, and parks department staff will continue to hold project status meetings to ensure that road and infrastructure design and construction in the rights-of-way surrounding the park, as well as improvements on adjacent properties being developed, are well coordinated. ALTERNATIVES: Per Commission. FISCAL EFFECTS: The Agreement will allow the project to proceed as previously approved. Box 1230 Bozeman, Montana, 59771-1230 (CITY) and DOWL, LLC, whose address is 2090 Stadium Drive, Bozeman, Montana 59715, (CONSULTANT). WHEREAS, the parties have entered into a Professional Services Agreement dated May 18, 2015, for design and engineering of the Bozeman Sports Park; and WHEREAS, revisions to the scope of services are necessary to complete the Project in accordance with the Master Plan approved by Commission; and WHEREAS, the parties desire to amend the provisions of this Agreement. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: The conditions and provisions set forth in the attached Task Order No. 3 for the Scope of Services for the Bozeman Sports Park (“Exhibit A”) are hereby incorporated in and made part of this agreement. For our proposal, we have based our inspection time and fee on and development of the site plans and specifications. SCOPE In developing our scope of work and cost DOWL has reviewed the Contract Documents, including plans and specifications for the athletic fields, irrigation, utilities, and site-civil work. DOWL will be teaming with Steiner-Thuessen, and Siegfried to provide inspection services for the Phase 1a improvements with a successful outcome. DOWL will perform inspection for certain elements of the project as outlined below:  Project Management  Shop Drawing and Submittal Review  Process RFIs  Review Pay Requests  Change order pricing review  Construction Staking (limited)  Materials Testing – Soils, Concrete and Asphalt  Utility Testing  Irrigation Inspection and Testing 62 Bozeman Sports Park Proposal for Construction Administrative Services August 8, 2017 Page 2 of 3  Control System Programming  Soil Amendment Testing These items are discussed in detail below. Project Management We have included a project management cost item which includes Project Management time associated with attending weekly project meetings (estimated at 16 meetings), Quality Assurance and other assumed project support coordination efforts. Shop Drawing and Submittal Review The design team will review all shop drawings and product submittals required by the specifications to determine compliance with the drawings and specification. Contractor will receive written response from reviewer. Process RFIs The design team will review and respond to any questions that come up from the contractor during construction. Change Order Pricing Review The design team will assist the owner to see if proposed change order amounts provided by subcontractors are reasonable and acceptable. Construction Staking DOWL will provide construction staking for project elements that are not required by the contractor to stake (building pads, fencing, utilities, etc). Offset stakes will be set as requested by the subcontractors. Any re-staking will be responsibility of the Contractor. Materials Testing Includes building pad preparation, backfill and compaction in play fields, parking areas and sidewalks. Compaction testing will be performed with a nuclear density gauge to verify materials below shallow foundations are adequate to achieve the design bearing capacity. Evaluation of soils will be conducted with the combination of moisture-density relationships, sieve analysis, and plasticity determination in the form of Atterberg limits. Concrete flatwork and asphalt will also be tested. 63 Bozeman Sports Park Proposal for Construction Administrative Services August 8, 2017 Page 3 of 3 Utility Testing Water main extension will have full-time inspection. Leak testing and line disinfection will be documented for the main to be put into service. Irrigation Inspection and Testing The design team will make site visits during construction of the irrigation system to ensure compliance with the drawings and provide guidance as necessary for field adjustments. It is estimated that 9 site visits will be required for the irrigation system, pump station, plantings ,and seeding components of the project. Control System Programming Steiner-Thuessen will provide basic programming of the central irrigation control system. Changes during construction that necessitate adjustment to the programming will be the responsibility of the contractor. The contractor will be responsible for final station assignments and run times. Soil Amendment Testing Samples will be taken of the amended soil for testing to ensure amendments have been added at the specified rates. COST DOWL proposes to work on a time and material basis not to exceed $100,000.00 DOWL appreciates the opportunity to submit this proposal and is open to any discussion in regard to scope and cost for this work.
