NOTICE OF BUILDING PERMIT RESTRICTIONS
FLANDERS MILL PHASE 3 SUBDIVISION
NOTICE IS HEREBY GIVEN to all potential purchasers of any lot in Flanders Mill
Phase 3 Subdivision, City of Bozeman, Gallatin County, Montana, that the final plat of the
subdivision was approved by the Bozeman City Commission before all required on and off-site
improvements were completed, as is allowed in Chapter 38.39 of the Bozeman Municipal Code.
As such, an Improvements Agreement was recorded with the final plat that stipulates the time
period during which all improvements must be completed, and those improvements were
financially guaranteed to the City of Bozeman by the Subdivider.
THEREFORE, BE ADVISED, that Building Permits will not be issued for Flanders
Mill Phase 3 Subdivision, City of Bozeman, Gallatin County, Montana until all required
subdivision improvements are completed and accepted by the City of Bozeman. These on and
off-site improvements including installation of on and off-site streets, striping, and related
miscellaneous improvements within the subdivision shall be completed prior to issuance of a
building`permit unless written approval is otherwise obtained from the City Engineering
Department. The streets, striping, and related miscellaneous improvements shall be completed
within 12 months of final plat approval. The interior sidewalks adjacent to private lots shall be
completed within 3 years of final plat approval. Building Permits will be issued prior to the
installation of common open space facilities and landscaping improvements and interior private
sidewalks as long as these items remain under financial guarantee.
