MEETING DATE: August 21, 2017 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign Public Access and Utility Easements for the Bozeman Midtown Urban Renewal District’s Lighting and Streetscape Project from CJ&J LLC. BACKGROUND: The Bozeman Midtown Urban Renewal District (Midtown District) (formerly the North Seventh Urban Renewal District) is working on a project to enhance the safety and aesthetics of the North 7th Avenue corridor by installing setback sidewalks, enhanced streetscapes, and decorative luminaries. The existing right-of-way along the corridor will not accommodate a sidewalk setback, so the district has been acquiring public access and lighting easements from property owners on a voluntary basis for one dollar ($1.00) and for other valuable consideration. The district is obtaining easements for the 3rd and 4th phases of the project between Peach St. / Durston Rd. and Mendenhall St. The MOU describes the nature of the project and the responsibilities of the parties. The only notable difference between this easement and most others acquired for this project is that the MOU stipulates the installation of a corner retaining wall, such as those installed elsewhere along the N. 7th Corridor, to accent the corner at the intersection of two major thoroughfares. The property owner is dedicating additional easement area for the installation of this feature. UNRESOLVED ISSUES: 130 2 The design and engineering cost estimate for the installation of the corner feature has not been completed at this time. ALTERNATIVES: As determined by the Commission. FISCAL EFFECTS: The easements each require one dollar ($1.00) of consideration.
