HomeMy WebLinkAbout1942-07-24 Bozeman, Montana July 24th, 1942 450 The Commission of The City of Bozeman met in reglllar session in the Commis,don Room, City Hall Building, Friday evening, .July 24th, 1942, at 7:30 o'clock P.M. Those being present were Mayor Busch, Commissioner Sorenson, Commissioner Landoe, City Attorney Aitken, City Manager \~linnell, Director of Finance Walter Davis and the Clerk, when the following proceedings were had to-wit: The minutes of the last regular sesAion were read, and it was moved by Commissioner Landoe, seconded by Commissioner Sorenson that the minutes be approved as read, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, I Commissioner Sorenson, Rnd Commissioner Landoe; those voting No, none. Airport -- Damages to Ike Brady The City Manager read the report of the Commis:,-'!ioners appointed by the Court to ascertain and assess the value of trle property sought to be appropria ted by the Ci ty in the condemnation proceedings of The City of Bozeman vs. Ike Brady and others, having to do with the condemnation of a 20-acre tract and the improvements thereon adjoining the Bozeman Airport. The Report stated that the Commissioners had awarded $200 for the land; ~~50 for fence; $200 for a Slaughter House, and $50 for the corrals; a total of $500; and that the per diem and expenses of the Commissioners while employed on the case amounted to $134.20, a total in all of $634.20. After discussion, it was moved by Commissioner Landoe, seconded by Commissioner Sorenson that the amount of the award and expenses totaling $634.20 be paid into the court; that a warrant be drawn on the Ci ty' s Airport Fund in favor of the Ci ty Attorney llpon his filing a proper claim for that purpose; that the City Attorneyb e instructed to apply to the Court for an order I of possession as prOVided by law, and further that he give notice of appeal from the award to the District Court, and the motion was c~rried by the following Aye and No vote; those voting Aye being .l'IIa'.1or BUSCh, Commissioner Sorenson and Commissioner Landoe; tho se voting No, none. Resolution No. 516 -- Lighting Assessment The Manager stated the Resolution levying the assessment for Lighting District maintenance :O.n the amount of $2,352.02, for 1942 had been prepared. He presented Reso- lution No. 516, entitled: A RESOLUTION OF THE COMN!ISSION OF THE CIT' OF BOZri:MAN, lWON'rANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANC-S AND ELECTRIC.'\L CURRENT COSTS I"OR SPECIAL IMPROVm~::mT LIGHTING DISTRICTS NUMB~mS 100, 284, 28(3, 2E-?,9, 290, 295, AND 300 OF' THE CITY 01" BOZ~~fAN, P1JRSUANT TO TEE PROVISIONS OF SECTION 5266, R. C. M. 1935. It was moved by Commissioner Sorenson, seconded by Commissioner Landoe thAt the Reso~ltion be provisionally passed and July 31st, 1942 be set as the date for hearing protests and the motion was carried by the following nye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Connnissioner Landoe; those voting No, none. I Resolution No. 517 -- Snow Assessment The Manager stated the Resolution levying the assessment for snow removal in the amoutn $346.98, for 1942 had been nrepared. Airport -- Joint meeting City & County Commissioners The Manager stated that the City and County Commissioners had met at the County Court House on Ji.il.y 22nd, 1942 to discuss plans for the joint operation and maintenance of the Bozeman Airport and to provide for the appointment of an Airport Board to have ,1urisdiction in the premises. Frank, County Commissioner It was unanimously agreed by the joint body that The Bozeman City Commlssion wouLd select two qualified persons to bE'l members of the Ci ty-County A~rport Board to serve with two qualified persons to be selec ted by the Board of County (jommis doners and tha t the four members so appoInted would select a fifth oual:ified person to become a member of said board and that sald board would thereby consist of five members whose duties would be to a~mme full ,jurisdic tion and. responslbili ty for the ma intenance and opera tion of the Galla tin Airport, and. to make all rules and regulations for the proper administration of the same; subject however, to the approval of the appointing power before such rules and regulations shall take effe~t, as prOVided by law. It was further agreed thAt the cost of such maintenanCA and opera tion shall be paid out of a 10int ~lnd to be created as set forth in Section 4 of Joint Resolution No. 512 men- tioned above, into which payments shall be deposited by the county and city in the propor- tion of 3.44 : 1; the county to deposit apporximqtely iji5,500.00 and. the City approximately $1,600.00 for the purpose of financing the operation and maintenance of the airport during the C1Jrren t fiscal year, the said fund to be placei in cus tody of the Treasurer of Galla tin County, Montana and disbursed by him upon order of the joint board herein prOVided for, by warrant properly signed by the proper offi cia1s of the said board. Appointments -- Airport Board In accordance with the agreement reached at the above meetine; and as a result of ballot cast by the Commission, the Mayor announced the appointment of Dean Cbaffin for a two-year term and Gardiner Waite for a three-year term as members of the City-County Airport Board. It was moved by Commissioner Landoe, seconded by Commissioner Sorenson tha t the appolnt- - ments be approved and the motion was carried b" the following Aye and No vote; those vot- lng Aye being rla;ror Busch, Commissioner BUSCh and Commis sioner Sorenson; those votlng No, none. 4,52 Expenses for ~lnicipnl League The City Attorney stated that the Montana Municipal League was to meet in Bozeman Augus t 21st and 22nd; tha tit is cus tomary for the has t Ci ty to mee t one-half of the ex- penses of the meeting and that the League had allocated $150.00 as its share of the expenses. It was, thereupon, moved by Commissioner Landoe, seconded by Commissioner Sorenson that $150.00 be paid to the President of the Montana Municipal League for the City's share o~ the cost of the convention, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Commissioner Landoe; those I voting No, none. Garba~e Contract 1942-43 The Manager reported that the bid of J. S. Miles in the amount of $845.00 per month for the collection and disposal of garbage for the Residence Distrlct was satisfactory and was the lowest and best bid. Bud~et -- 1942-43 The Manager stated the prelim:1.nary budget should be presented and approved on or be- fore the 25th day of July. He therefore, presented the preliminary budget to the Commis- sion, wbereupon, it was moved by ComT'1issioner Landoe, seconded by Commissioner Soresnon that the preliminary budget be approved and July 31st, 1942 be set as the date for a I public hearing in connectJon witb the budget; and that the Clerk be authorized to publish a notice in accordance therewith and the motion was carried by the following Aye and No vote; those voting Aye being lVfa;Tor Busch, Commisrdoner Lsndoe and Commissioner Sorenson; those voting No, none. Repor t The Engineer's report for the six months period ending June 30th, 1942 was presented.
