COMMISSION RESOLUTION NO. 4831
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING THE ALLOCATION OF CASH-IN-LIEU OF PARKLAND
DEDICATION FUNDS FOR IMPROVEMENTS TO OAK MEADOWS PARK
WHEREAS,the Oak Meadows Subdivision Homeowner Association has submitted an
application for the use of cash-in-lieu of parkland dedication funds for construction of a
playground and other improvements in Oak Meadows Park; and
WHEREAS, a cash-in-lieu of parkland dedication contribution of $102,600 was
received from Big River Development,Inc.to make up for a shortfall in parkland acreage required
to be dedicated with development of Oak Meadows subdivision;
WHEREAS, Section 38.27.030 (F.)(1.) of the Bozeman Municipal Code, ("Cash
Donation in lieu of Land Dedication") states: "The city shall use a cash donation for development
or acquisition of parks to serve the development;" and
WHEREAS,the Recreation and Parks Advisory Board at their regular meeting of June
8, 2017 unanimously passed a motion recommending that Commission approve the allocation of
$102,600 from the cash-in-lieu of parkland dedication account to the Oak Meadows subdivision
park improvement project;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman,Montana,
Section I —Municipal Code Reference
In accordance with Section 38.27.030 (F.M.) of the Bozeman Municipal Code,the
cash-in-lieu of parkland dedication contribution provided by Big River Development, Inc. will
serve the Oak Meadows subdivision for which it was intended; and
Section 2 —Funding Authorization
The allocation of $102,600 from the cash-in-lieu of parkland dedication account is
hereby approved for the Oak Meadows subdivision park improvement project.
PASSED, ADOPTED, AND APPROVED by the City Commission of the City of
Bozeman, Montana, at a regular session thereof held on the 171h day of July, 2017.
