HomeMy WebLinkAbout1942-10-30 4t7() Bozeman, Montana October 30th, 1942 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Friday evening, October 30th, 1942, at 7:30 o'clock P.M. Those being present were Mayor Busch, Commissioner Sorenson, Commissioner Landoe, City Manager Quin- nell, City Attorney Aitken, Director of Finance Walter Davis, City Engineer Thorpe, and the Clerk, when the following proceedings were had-to-wit: The minutes of the last regular meeting were,read and it was moved by Commissioner Landoe, seconded by Commis ::.doner Sorenson tha t the ml m tes be approved as read and the motion was carried by the following Aye, and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. Communication -- H.B. No. 202 The Manager read a communication from the Montana Municipal League urging the sup- port of House Bill No. 202, providing for a four-year term for elective officers of cities and towns. Rental Rates for Space in Armory The Manager read a suggested resolution, covering rates to be charged for the use . of the Armory Garage, Drill Hall, and Community Room, for the consideration of the City Commission. No formal action was taken, it being understood that the matter would be brought up for further discussion at a later meeting. The Manager stated the AAA desired to lease the Community Room, and it was thought they would pay about $25.00 per month for itsuse. After discussion, the Commission ex- pressed approval of leasing the Community Room to the AAA at a rate to be determined la ter. Appeal of Tax Case The City Attorney stated that in the case of Antionette Hartman vs The City of Bozeman to qui t title, which involves an assessmen t agains t certain property in Special Improvement District No. 296, for the year 1940, had been decided against the City. He asked the Commission for authority to appeal the case to the Supreme Court stating that a Supreme Court Decision in this case would be of great value to the City in deciding similar caseswhich might arise in the future. It was moved by Commissioner Sorenson, seconded by Commissioner Landoe that the Ci ty Attorney be authorized and directed to appeal to the Supreme Court from the judg- ment rendered by the Dlstric t Court in t he case of Antionette Hartman vs Della Mimmack, The City of Bozeman, and others, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Thlsch, Commissioner Sorenson and Commissioner Soren- son; those voting No, none. CO!T'mnication Mayor Busch read a communication urging the attendance of the City Attorney to the National meeting of Municipal Law Officers to be held in New York City. A copy of the letter written by Walter Aitken, stating that in his opinion the benefits received would not be worth the money expended for such a trip and meeting, was read by the Mayor.
