HomeMy WebLinkAbout1943-01-22 49G Bozeman, Montana .January 22, 1943 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Friday evening, Janu8.ry 22, 1943, at 7:30 o'clock P.M. Those being present were Mayor Thlsch, Commissioner Sorenson, Commissioner Landos, City Attorney Ai tken, City Mana.ccer Quinnell, and the Clerk, when the following proceedings were had to-wi t: The minutes of the last regular session were read, and it was moved by Commissioner Landoe, seconded by Commissioner Sorenson, that the minutes be approved as read and the motion was carried by the following Aye and No vote; those voting Aye being ~Iayor Bus ch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. Applications for City Licenses The following applications for City Licenses were presented and read: Bra ten's Bobcn.t Lunch Owsley's Inc. Heidel Agency Dr. H. Culbertson Gallatin Drug Company Helena Cream Station Bennet-Stith Agency Kenyon-Noble Lumber Company Gallatin County Abstract Co. It was moved by Commls R ioner Sorenson, seconded b;,' Commis f'ioner Landoe tha t the appl:i- ca tions be approved and the licenses issned and th.e motion was carried by the following Aye and No vote; those vo ting Aye being Ma;ror Busch, Commis si oner Sorenson and Commis 8. oner Landoe; those voting No, none. Airport The Manager stated he had beer offered :$10.00 for the old barn located on the Airport. After discussion, he was instructed to make further inquiry for bids before accepting this Sale of COlmty Welfnre Building The Manager stated that the City Attorney, The Director of Pinance and himself had appeared before the County Commissioners on this dDte to talk with them concerning the delinquent taxes on the Welfare Building. The Manager stated further thr~t the County Attorney hnd presented an opinion stating it was not necessar;y for the County Commissioners to offer trJe property for sale if they needed it for County purposes, and that the cou:r.ty C0l11d not buy it from themselves. An opinion by the City Attorney in answer to the County Attorney's opinion was pre- sented and read, stating th~t in his opinion, the County Commissioners nmst offer the property for sale and the. t the law c1 ted by the County Attorney did not apply in this case. The Attorney stated that the Count:;T Commissioners, and the County Attorney had been presented with a Cdpy of his opinion. After discussion, it was moved by Commissioner Landoe, seconded by Commissioner Sor- enson tha t if the prOpf!rty is not offered for sale by tlle County COl'!1missioners in accordance with the opinion of the City Attorney that he be authorized to start proceedings in the District Court to compel such action, and the motion was carried by the following Aye and No vote; those votlng Aye be:'Lng Ma;ror Busch, Commissioner Sorenson and Commissioner Landoe; those voting No, none.
