Bozeman, !'ontana October 17, 1941 The Commission of The City of Boz2man met in regular session in the Commission Room" City .Hall Building, Friday evening, October 17'th, 1941, at 7:.30 o'clock P. M. Those being present were :r\~ayor Hoey, Commis sioner Bus ch, Gommis sioner Sorenson, Ci ty At t.orney Ai tken, City Manager Lake, Director of Finance Walter Davis and the Acting Clerk, when the follow- proceedinGs were had: I The minutes of the last regular session were read, and it was moved by Commissioner Sorenson, seconded by Commiss10ner Bus ch tha t the minutes be a pproved as read and the motion was carried by the following Aye and No vote: those vo~ng Aye beine Mayor Hoey and Commissioner Sorenson and Commissloner Busch; those voting No, none. Resolution No. 510, Vacating part of North Rouse Axe. The Manager s ta ted, tha t as ins truc ted, the C1 ty Attorney had prepared the resolu tion of intention to vacate a part of North Rouse Avenue along its West boundry, between the South line of East Beall Street and the North line of the alley in Block "D"r of the Ori- ginal Townsite. He presented Resolution No. 510, entitled: A RESOLUTION OF" TIm COM1\TISSION 01<' THE CI'rY 01" BOZ~:MAN, :MONTANA DECLARING IT TO 13:8 TEE: INTEN1'IOlJ OF' SAID CITY TO VACATE AND DIS- CON'l'INUE A pQ.RrrIOlT OB' ROUSE A Vl.;;NUE NOnrrH, IN SAID CITY AS PARTI- CULARLY IN ~'HIS RESOLU'rION HEHEINAFTER DESCHIBED AND FOR 'lIIIE HEASON AED FURPOSES THEREIN EXPRESSED. It was moved by Commissioner Sorenson and seconded by Commissioner Busch that the Hesolution be passed and adopted and that October 31st, 1941 be set as the date for public hearing and the motion was carried by the following Aye and No vote; Those voting Aye being !\'Tayor Eoey, Commissioner Busch and COImnissioner Sorenson; Tll.oSO voting No, none. The report of the water analysis of the State Board of Health was presented. It I REfORT ON '/fAT2R AKALYSIS: was moved by Commissioner Busch and seconded by Cornmissioner Sorenson tha t the report be accepted and ordered filed and the motion was carried by the following Aye and No vote; Those voting Aye being Mayor Roey, Co~~issioner Busch and Commissioner Sorenson: those voting No, none. Communications: The ri~anager read a communica tion from Mr. L. H. Richardson, Chairman of the Montana Armory Board acknowledging receipt of the City Manaser's notice of withdrawal of the City's offer to contract for a lease on the Armory Building, :rv:r. 11ichard:aon stated that he would contact the Comr.:.ission soon and try to clear up the misunderstanding a s to who shall furnish a caretaker for the Armory. No action was taken. The Manager reported that he had received a letter from Mr. R. D. Beddinger, in re- gard to zoning the property adjacent to the Bozeman Airport, :rvtr. Beddinger stated that there is no Federal law providing such Zoninc.; and that it is the responsibility of the local governments to provide for such. The matter was turned over to the City Attorney for investigation, and for him to advise later as to wr~t may be done toward protecting the users of the port f,rom 'man made hazards. I The Manager read an invitation from the National Institute of Municipal Law Officer, asking that the City Attorney attend the Conference at Washington D. C. on December 4th, 5th and 6th, 1941. The matter was laid over to a later date. Donation to Recreation Fund: I I I The Manacer presented a letter from Mr. Harlow B. Mills, addressed to Mayor IIoey wi th a check from Mr. Mills for $2 50. l'lr. Mills asked in his Ie tter tha t the mone y be used for City recreational activities. The r:ift was accepted by the Commission and the MSlJIlager was instructed to extend their thanks to Mr. :Mills. ";Ja tson Acciden t:: The Manap;er presented a communication" rom Mrs. L. W. Watson of 207 No. Black Ave, nue. Mrs. Watson stated in her letter that she had met 'with an accident at the corner of North Black Avenue and East Lamme Street while walking with her daughter toward home on the eveinz of October 6th, 1941. Mrs. Watson further stated that she believed the accident to be caused by tripping over a faulty gutter plate, that she felt that the City was to blame for the condit:i.on of the corner and that she was entitlerl to dalilages in the Rmount of :~500.00, that if the ,~j500.00 was paid to her by the City, she would ma.l{e no further claim on account of this accident. After discussion, it vms movecl by Com- missioner Busch and seconded by Comndssioner Sorenson th~t the case be turned over to the City Attorney for investigation and the motion was carried by the following Aye and No vote; those voting Aye beinE!, Mayor Roey, Conunissioner Busch and Corrrnissioner Sorenson;: those voting No, none. Purchase of Fire Siren: 'Ilbe matter of purchasing a fire siren for the Fire Department vms ae;ain taken up and after considerable discussion of the various sirens quoted, it was moved by Com""' missioner Busch and seconded by Commissioner Sorenson that the offer of the Americ~n LaFrance Foamite Industries Inc. of Spokane, Viashinston be accepted and that the Manager order the Sterling, 5 H. P. model TIM": double head siren, quoted at '1~360.00 and one Sterling remote control unit quoted at $40.00 and one Sterling control box quoted at $30.00, all F. O. B. factory and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Hoey, Commissioner Busch and Connnissloner Sorenson;, those voting No, none. ADJOURNMENT There being no further business to come before the Board a t this t 11':1e, it was moved by Commissioner Sorenson and Seconded by Connniss:loner Busch till t the meeting adjourn and the motion vras carried by the following Aye and No vote; those voting Aye being Mayor Hoey, Commissioner Busch, and Commissioner Sorensonj those v otinfj No, none.
