April 4th, 1941
The Commission of The Ci ty of Bozeman met in regular sesm on in the Commission
Room, City Hall Building, Friday evening, April 4th, 1941 at 7:30 o'clock P.M. Those
being present were Mayor Hoey, Commissioner Busch, Comnlissioner Sorenson, City Attorney
Aitken, City Manager Lake, Director of Finance Walter Davis and the Clerk, when the
following proceedings were had to-wit:
The minutes of the last regular session were read and 1 t was moved by Commissioner
Buscb, seconded by Comrnls sioner Sorenson tha t the minutes be approved as road and the
motion was carried by the following Aye and No voto; those voting Aye being liIayor
Hoey, Commissioner Busch and Comnlissioner Sorenson; those voting No, none.
Parade for Jaycee Roundup
Mr. Loren T. Marshall, of the Junior Chamber of Conunerce appeared before the Com-
mission, to request that Main Street be cleared of cars for two hours before the Round-
up parade t.o be held in August. Mr. Marshall was informed that he could be assured
of the co-operation of the City for the parade and that with the help of members of
the Junior Chamber of Corr..merce trlat I'o'Taln Street could be kept clear of cars for this
purpose.

Offers for stevenson 80
The Manager stated he had received several offers for the Stevenson 80 and a
representative for each offer submitted was present. The },:ayor asked those present
if they would be willing to have auction bidding after all offers had been opened and
read. All those present gave their consent.

It was moved by Commissioner Busch, seconded by Connnissioner Sorenson that the
bid of Kenneth Kraft be accepted and the City Attorney be instructed to prepare a
resolution of intention to sell this property to Kenneth Kraft and the motion was
carried by the following Aye and No vote; those va ting Aye being Mayor IIoey, Com-
missioner Buscl1 and Comrni~sioner Sorenson; those voting No, none.
Barn -- 322 South Black
Dr. L. A. Petrauscrl appeared before the Co:rmnission to ask what had been done re-
garding her petition requesting the barn at 322 South Black, now beIng used as a

planinG mill, be condemned. Fire Chief Matthews was present and stated he and the
Sta te Fire Marshall had inspec ted the barn and the occupant Th'1d beer; ins true ted to
clean-up the building and keep it in a safe condition. The City Attorney stated he
would check in to other cases subml tted to the court, for property to be condemned as
fire hazards, and also contact the state auditor regarding the condewning of the building.
Equipment for Street Department
Mr. J. A. Ring, of the Empire Equipment Company, appeared before the Commission and
discussed with them equipment for the maintenance of :raved streets.
Claims for the I.Ionth
The claims of RD,y l,~arks, James E.'merson and Earl Paxton in the a moun t of .wl.50 each
and all for witnesses' fees in the case of Montaha State College vs Joe Pacovsky were
;~resented. The claims were discussed, and it was pointed out that all three claimants
were employees of and subpoenaed by the plaintiff and therefore didn't lose any pay;
that it should be their civic duty to apIBar as witnesses. It was moved by Commissioner
Busch, seconded by Commissioner Sorenson that the claims of Ray Marks, James Emerson
and Earl Paxton be disallowed and the motion was carried by the following Aye and No
vote; those voting Aye being Mayor Eoey, Commissioner Busch and Commissioner Sorenson;
those voting No, none.

The Manager sta ted tha t he has audi ted these claims and finds thet"l to be true and
lawful claims against The City of Bozeman and recommends that warrants be drawn for their
payment, and after examina tion of the claims in de tail by the Commis sion, it was moved

Ordinance No. 709 -- Band Levy
The Manae;er stated the ordi-nance amending the Band Ordinance so as to set the levy
at not exceeding one mill had been prepared. He presented Oruinance No. 709, ontitled:
AN ORDINANCE AMENDING SECTION 3, OF ORDINANCE NO. 521 OF THE CITY OF
BOZEMAN ENTITLED: "AN ORDINANCE PROVIDING POB .PUBLIC BAND CONCERTS
IN THE CITY OF BOZEMAN."

Application for City License
The application of Julian S. Miles for a Cit::' License was presented and read. Itwas
moved by Com~issioner Busch, seconded by Commissioner Sorenson that the application be
approved and the license issued anJ the motion was carried by the following Aye and No

Examination of Depository Bonds
The Director of Finance presented a report of Custodian's Receipts of Depository
Bonus held by The City of -Bozeman to cover deposits in the various banks in the City.
The receipts were exam::ned by the Commis sion, whereupon, it was moved by Commissioner
