HomeMy WebLinkAbout1941-05-02 310 Boze1"1an, Montana Nlay 2, 1941 The Commission of The City of Bozeman met in rer.;ular session in the COnL'tYlission Room, City Hall BUilding, Friday evening, May 2, 1941, at 7:30 o'clock P.M. Those being present were :Yayor IIoey, Commissioner Busch, Commissioner Sorenson, Cit:yAttorney Aitken, City Manager Lake, and the Clerk when the following proceedings were had to-wit: The minu te s of the 1 as t regular s es aion were read, and it was moved by Commis sioner Sorenson, seconded by Commissioner Busch ttlat the minutes be approved as read and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Eoey, Comrnis8ioner Busch and Commissioner Sorenson; those voting No, none. Carnival for J~ycee Roundup Mr. J. 8hirgwin and Ott Tscbache of the Junior Chamber of Commerce were present and presented a written request that no license fee be charc;ed i'or the Carnival which is to play Bozeman during the week of the Jaycee Roundup. They also requested The Oi ty of B07.eman not to. perMit any other carnival to play Bozeman the thirty days previous to the Roundup, which is to be held August 1 to 3rd, 1941. Afte r discussion, with those present, the Commis' ion was agreed to grant the request of the Junior Chambe r of Commerce. Assistance for Clean-up Week. Mr. Don Griffin and Ray Hartman representing the City Beautification Committee of the Junior Chamber of COn1.r.'TIerce appeared before the Commission and offered au c:C'estions and any assistance they could to the Cit-:l d1Jring Clean-up ':,'eek. Request for Sidewalk rllr. & Mrs. Joe Livers appeared before the C01T'.mis sion to as k if sidewalk connec tlng their sidewalk to Fifth Avenue had been ordered constructed this year and they were in- formed this walk was listed on the Dl)proved list. Mr. & Mrs. Livers also stated, that in their opinion, the Commission should order Arthur Street between Fourth and Fifth Avenue to be paved. Parking on North Seventh Street Mr. Dan Kilbride appeared before the Commission to discuss the parking of cars- on North Seventh Street between Main and Mendenhall, but no change in the present plan was offered. Misc. 'n & C 1941 The Ci ty Engineer acting under the provisions of Sections 5244 and 5039.64 R.C .M. 1935, and the prOVisions of Ordinance No. 561, relative to the constrllction of Jdsc. Vi & C without the formation of a special improvement district, having submitted his report and recommendations for 1941 in detail with reference to needed repairs and new instal- lation; ancl the City Commission and City ManaGer having checked the report and made per- sonal inspection as to the recommendations of the City Encineer, recommend the adoption of the report as submitted. It was moved by C01T'.missioner Sorenson, seconded by Commis sioner Bus ch that the re- port of the City Engineer as to the repair and installation of Misc. W & C 1941 be and the same is hereby accepted, approved, adopted and ordered filed and ordered to be made before Juno 16th, 1941; that said report of the City Engineer is hereby adopted and re- ferred to and made a part of this minute entry by such adoption and reference for the I I I I I I 311 purpose of designating and identifying the streets and avenues on v/hich such new instal- lation and repairs are to be made; that the City M:anager 1s hereby instructed to give, or cause to be given written notice to each owner or the agent of such owner, of the property along which such new ins talla tieD or repair is to be made as required by said sections and Ordinance and the motion was carried by the followin[j Aye and No vote; those voting Aye bei r.g Mayor Hoey, Commis sioner Busch and Commissioner Sorens on; t hos e vo tine; No, none. Release of Bond of I.nui.9:\:rueger The M.anager read a communi.cation from the Eartford Accident and Indemnifying Com- pany requesting the bond of Louis Krueger as a gas fitter be released. 1'he IV~an a2 er -' stated that Louis Krueger is no longer operating as a gas fitter in the City. It was moved bv Commissioner Sorenson, seconded by Commissioner Busch that the bond be released and the motion was carried by the following Aye and 1'''1 vote; those voting Aye being Ma:or IIo ey, Corrrd S8 ioner Busch and COIl1-1Tlis sioner Sorens on; those vo tIng Ko, none. Sewer Connections Ordered The Manager presented a list of houses where sanitary sewers are available and the owner has not made connection to the sanitary sewer. After examination of the list, it was moved by Commis ~ioner Busch, seconded by Commis si oner Sorenson th", t the owners be notified and ordered to connect to the sanitary sewer and the motion was carried by the following Aye and No vote; thoC"e voting Aye being Mayor Hoey, Commis~1ioner BUBel:! and Commissioner Sorenson; those voting No, none. Agreement for sale of Real Estate Cancelled The Manager stated tho.t the agreement with B. l'L Crenshaw to purchase Lot 16; Block E; Original Townsite provided that in the event of default by Crenshaw for pa~rment, the ac;reerren t shall termina te; ths t the R[';reemen t has been in defaul t for arproxima tely five months, and no arrangements have been made to extend tho time of payment. The matter was discussed by the Commission, and it was moved by CommisfJioner Busch, seconded by Commissioner Sorenson th8.t the agree-rnent with B. M. Crenshavv' to p1Jrchase saId lot be cancelled and the motion was carried by the following Aye and No vote; th08 e voting Aye being Ma~Tor Hoey, vommissioner Busch and Commissioner borenson; those voting No, none. After examination of the cla:tms in detail by the Commission, it was moved by Commissioner Sorenson, seconded by Commissioner Busch that the claims be allowed and warrants be drawn for their pa'yment and the motion was carried by the following Aye and No vote; those votjng Aye being Mayor lIoey, Commissioner Busch and Commissioner Soren- son; those voting No, none. Recommendl.'l tions for AmendPlon ts to Zoning Ordinance The Manager presented the following recommendations of the Board of Adjustment rela ti ve to amending the Zoning Ordinance: Zone the Wes t Side Addi tion as "c" Residence Zone Define more clearly Continued Use, Front Yard and near Yard. Regulations as to fences. Side Yard space in the Business Residence Districts. Tha t the sale of liquors and public dance halls be prohibi ted in the Thlsiness-Residence Districts. That all business in the Blls:lness Residence Districts cease btlSiness between the hours of midnight and 7 A.M., except the renting of places of lodging. The recommendations were discussed and approved by the Conrrnission, and theei ty Attorne;{ was insttructed to prepare the proper notice for a public hearing and set the date and place for sane.
