The Cow.mission of The City of Bozeman met in regular session in the Commission Room,
Ci ty Hall Building, Friday evening, ~Tuly l2, 1940 at 7 :30 0' c10clc P.M. 'Those being presen t
were Mayor Hoey, Commissioner Busch, Commissiormr Lake, City Attorney Aitken, City Man-
ager Henderson, Direc tor of Finance Wal ter Davis and the Clerk when the following pro-
ceedings were had to-wit:
The minutes of the last regular session were read and it was moved by Commissioner
BUSCh, seconded by C0J11J11.1ssioner Lake that the mInutes be ap:oroved as read and the motLm

Ci ty - Coun t~T Heal th Uni t.
Dr. A. D. Brewer, City-Colmty Health Off'icer, appeared before the Cor.nni::sion to
recomIn.end tha t the Ci ty Milk Ordinance be amended or rewr it ten to complJT wi th the ree;ula-
tions of the State Livestock Sanitary Board. Dr. Brewer was instru.cted to secure copies
of the regl11ations of the State Livestock Sani tary Board, to list the changes required
in the present milk ordinance to make it comply with the State reGUlations, and present
his def ~.ni te recommenda tions So they can be incorpora tea in a new ordinance.
Dr. Brewer also presented the proposed budget for the Ci ty-County Heal th Uni t for the
fiscal year beginning July 1,1940. He stated that School District 1\0.7, which has been
contributing $680.00 per year to the Health Unit, finds it necessary to cut their contri-
bution this year to $180.00 and that, unless it is possible to raise the contributions
of The City of Bozeman and Gallatin County, it may become necessary to dispense with the
services of one of the Health Unit nurses dur3ng this year. The Manager recommended
tha t the con tributlon of' the Ci ty be raised $100.00 for the year beginning .July ls t,
1940, on condition that there be no decrease in personnel or curtailment during the
year in the service being renderedby the Heal th Uni t.
After discussion, the Manager was instructed to meet with the Count:T Commissioners
to make the offer which he recommended and to urge too t they continue the Heal th Uni t
without cut in the present service or personel.
Public Bearing SID No. 335
The Manager stated that this was the time and place set for hearing protests to the
creation of Special Improvement District 1\0. 335, pav:;_ng of Arthur Street betweer:: TJ::ird
and Fourth Avenues. He presented affidavi t of publication of the l';otice and the Clerk's
Mailing Certificate that all property owners had been notified. The written protest of
1,:rs. H. S. Cannon representing 28.8;& of property owners was presen ted. l\frs. Cannon was
present to state her reasons f'or protesting. After discussion, it was trnved by Commis-
sioner Busch, seconded by Commis sioner Lalce thn t the protes ts be overruled as insufficlen t
in law and in fact and that the Cit:r Attorney be Instructed to prepare the resolution
to crea te the dis trict and the mo tion was carried by the following Aye and No vote; those
voting Aye being J.la:ror Hoe~r, Conrrnissioner Busch and Commissioner Lake; those voting No,
none.
Resolution No. 472 -- Creating SID No. 335
The Manager stated that the City Attorney as instructed had prepared tbe Resolution
creatlng Special In:provement District No. 335, paving of Arthur Street between Third ond

Fourth Avenues. He presented Resolution No. 472, entitled:

It was moved by Commissioner Busch, seconded by Commissioner Lake that the Resolu-
tion be passed and adopted and August 2nd, 1940 be set as the date for opening bids
and the motion was carried by the following Aye and No vote; those votlng Aye being
Ma:Tor noey, Commissioner Busch and Commissioner Lake; those voting No, none.
Bids for SID No. 334
The Manager stated that this was the time and place set for the openeing of bids
for the construction of Special Improvement District No. 334, sanitary sewer on North
Rouse between Lamme and Aspen Streets. He presented affidavit of publication of the
Notice to bidders, whereupon, it was moved by Commissioner Lake, seconded by Cornmis-
sioner Busch that the bids be opened and the motion was carried by the following Aye
and No vote; those vo ting Aye being Mayor Hoey, Commis sioner Busch and Commis sioner
Lake; those voting No, n)ne.

Reques t for Extension of Time - - 1N& C 1940
rrhe Manager stated that Mr. D. S. Williams had made verbal request, for School
District No.7, that sidewalks ordered in along the Irving School grounds on the 1940
list of Misc. W & C be allowed to rem.ain unbuilt until 1941. It wasrroved b~T Com-
missioner Lake, seconded by Co~issioner Busch that the request be granted and the
mo tion was carried by the following Aye and No vote; those voting .Aye being Mayor Hoey,
Commissioner Bus ch and Commis s1 oner Lake; those vot.ing No, none.

Purchase
Wa ter Meters
The City Manager requested authority to purchase 25 five-eighths and 3 one-inch
water meters. He stated that the approximate cost of these meters would be $350.00.
It was moved by Commissioner BUSCh, seconded by Commissioner Lake that the Manager be
authorized to make this purchase and the motion was carried by t he following Aye and

Spokane Convention -- Fire Chief Attendance
The Manager stated that Fire Chief W. O. Matthews had requested authority and leave
to a ttend the convention of the Interna tional Assocla tion of Fire Chiefs to be held at
Spokane, Washington, August 5 to 8, 1940, and that 1:1s expenses incurred in such atten-
dance be paid by the City. After discussion, the matter was tabled until the next
meeting.
Leave of Absence -- City Manager
The Manager reque sted a leave of' absence to attend Na tional Guard Camp a t Port
Lewis August 4 to 24, 1940. It was moved by Commissioner Busch, seconded by Commissioner
Lake that the leave of absence be granted and the motion was carried by the following
Aye and No vote; those voting Aye being Mayor Hoey, Corrn:;liss.Loner Busch and Commissioner
Lake; those voting No, none.
Adjournment
There being no further bus~.ness to come before the Cornmis::-:"on at tLis time, it
